TODAY IS TUESDAY, MAY 10TH, 2022 9:00 AM.

AND WE'RE IN THE COMMISSIONER'S COURT MEETING ROOM LOCATED IN THE COURTHOUSE ANNEX.

UH, WE'LL START OUR MEETING TODAY.

I'LL OFFER AN INVOCATION FOR US AND, UH, COMMISSIONER BARBARA IS GOING TO LEAD US IN THE PLEDGES.

PLEASE STAND HEAVENLY FATHER.

WE THANK YOU FOR ALL THE BLESSINGS OF THIS LIFE.

UH, WE ASK THAT YOU GUIDE US AS WE MAKE, UH, AS WE TRY TO MAKE THE BEST DECISIONS FOR THE BENEFIT OF OUR CITIZENS OF KAUFMAN COUNTY.

WE ASK THAT YOU GUARD AND PROTECT THOSE WHO PROTECT US AND THE ARMED FORCES AND OUR, UH, ALL OF OUR FIRST RESPONDERS.

IF YOU WOULD, UH, COME UP HERE, GIVE US YOUR NAME AND YOUR ADDRESS AND THE FLOOR'S YOURS.

MY NAME'S MARY BULLARD AND I LIVE IN TERRELL, TEXAS ON GRIFFITH AVENUE, 7 29 GRIFFITH AVENUE TECH, UH, TERRELL, WOULD YOU HOLD THAT MICROPHONE DOWN JUST A LITTLE BIT CLOSER TO YOU? YES, SIR.

AND I ALSO OWN A BUSINESS IN THE SAME PRECINCT OF THAT LIBYAN AND IT'S CALLED BULLARD'S FIREWORKS A FEW WEEKS AGO.

WE HAD SOME DISCUSSION ABOUT FIREWORKS AND THE THREE HOLIDAYS AND THINGS LIKE THAT, BUT I'M HERE TO JUST ASK WHAT WE'VE ALWAYS ASKED FOR, AND THAT IS JUST TO BE ABLE TO SELL, UH, FOR THE MEMORIAL HOLIDAY.

AND, UH, WE START, I LOOKED BACK AND WE WERE RECORDING OUR MEETINGS AT THE TIME, UH, 2017, ABOUT HOW THAT WHEN WE WENT, WHEN WE FIRST WENT AND WE, UH, GOT THE PERMISSION TO SELL IT.

AND SINCE THEN, TO MY KNOWLEDGE, THERE HASN'T BEEN A MAJOR IMPACT ON THE COUNTY.

AND ONE OF THE THINGS THAT WAS SAID, MR. HUNT WAS THE ONE THAT SAID IT IN THAT MEETING, YOU SAID THAT LET'S SEE WHAT HAPPENS.

AND SINCE THEN IT'S BEEN GOOD.

WE'VE GOT A LOT OF PEOPLE IN OUR COUNTY THAT RELIES ON THEIR FIREWORKS.

INCOME ME IS, IS ONE THAT I, I KNOW WHAT HAPPENS.

I HAVE A PROPERTY TAXES, I HAVE TO PAY INSURANCE.

I HAVE TO PAY ELECTRIC BILLS AND ALL THE OTHER THINGS THAT GOES WITH A SMALL BUSINESS.

AND THEY GO ON WHETHER I OPENED MY DOORS OR NOT.

SO I HOPE THAT THE COMMISSIONER'S COURT WILL LOOK AND SEE THAT THE FIREWORKS PEOPLE HAVE TRIED REALLY HARD TO, TO, UH, MAINTAIN THEIR BUSINESS ON THEIR OWN WITHOUT ASKING FOR A LOT OF DIFFERENT THINGS AND, UH, ALLOW US TO OPEN OUR BUSINESS FOR THOSE FEW DAYS.

IT'S ONLY THE HOLIDAY PLUS FIVE DAYS.

IT'S JUST A VERY SHORT PERIOD.

AND, UH, IT'S VERY IMPORTANT TO US.

UH, QUESTIONS FOR MS. BULLARD.

WE HAVE A COUPLE OF, UH, I HAVE SOME OTHER FOLKS THAT HAVE JOINED US TODAY THAT HAVE SUBMITTED CARDS THAT WOULD LIKE TO SPEAK ABOUT THIS ITEM ON THE AGENDA.

UM, I WAS SURPRISED AT LAST COURT APPEARANCE AND WAS UNPAIR UNPREPARED TO ADDRESS YOUR CONCERNS AND COMMENTS ABOUT THE MEMORIAL DAY FIREWORKS.

SO I MADE SOME NOTES.

UM, OUR FIREWORKS STANDS HAVE BEEN OPENED THE PAST FEW YEARS, AND WE ASSUMED THAT THERE WAS A STANDING ORDER, UH, VERY SIMILAR TO THE OTHER COUNTIES SURROUNDING KAUFMAN COUNTY, UM, UH, THOROUGHLY LISTENED TO YOUR COMMENTS AND HAVE NOTES TO ADDRESS THEM TODAY.

UM, I ALSO HAVE SOME ADDITIONAL INFORMATION IN HOPES TO GET IN YOUR APPROVAL, UH, TO HELP OUR SMALL BUSINESSES AND MANY SMALL BUSINESSES IN KAUFMAN COUNTY, UM, TO OPEN UP DURING THIS HOLIDAY, UM, ONE OF THE CONCERNS THE BOARD ARE THEY RIMMER IMMIGRANTS.

I AGREE WITH YOUR SENTIMENT AND THANK YOU FOR YOUR THOUGHTS AND PRAYERS FOR OUR FALLEN MILITARY IS MUCH ADMIRED AND WE HAVE LOST MANY TO PROTECT OUR FREEDOMS, AND WE MUST NOT FORGET.

UH, MEMORIAL DAY IS ONE MORE CELEBRATION FOR THE FALLEN IN MANY WAYS.

UM, COUSIN'S PAIN BALL.

UM, MY BUSINESS IS A VETERAN FIRST RESPONDER OWNED BUSINESS.

I'M A VETERAN AND MY WIFE HAS A TRAUMA ICU NURSE.

UM, WE HIRE, UM, MANY VETERANS TO OPERATE AND RUN OUR BUSINESS, THE FIREWORKS, UH, MOSTLY AS WELL AS OUR PAYROLL BUSINESS THAT'S OPEN YEAR ROUND.

UM, WE ALSO EMPLOY HIGH SCHOOLERS, COMMUNITY MEMBERS, UH, FORNEY AND FORNEY COMBINE CRANDALL AND THE SURROUNDING TOWNS.

UM, THESE TEAM MEMBERS DEPEND ON THIS ADDITIONAL INCOME, MORE THAN EVER WITH THE, UH, THE INFLATION AND THE GAS PRICES AT THEIR ALL TIME HIGHS.

UM, AND SOMETIME, UM, TRADITIONALLY DURING THE MEMORIAL DAY HOLIDAY, UM, CAUSES PAYWALL PROVIDES A FREE POPPING PARK.

IT'S A SAFE AND CLEAN ENVIRONMENT FOR COPLAN COUNTY, UM, UM, FOLKS TO ENJOY, UH, FIREWORKS, UM, IN A SAFE, CLEAN MANNER.

UM, I HAD THE PLEASURE, UH, LAST WEEK OF WORKING WITH, UH, DEPUTY MARSHALL BA UM, BOEING DURING OUR INSPECTION.

SHE MENTIONED THE MARSHALL'S OFFICE WAS SHORTHANDED.

IT WAS A RELIEF.

THE INSPECTOR SAYING STAY IN SOONER THAN LATER.

UM, AS THEY HAVE OVER A HUNDRED SANDERS IN THE COUNTY TO BE DONE BEFORE MID JUNE, UH, THE INSPECTION HAS DONE ONE TIME ANNUALLY, UH, WHICH IS GOOD UNTIL JANUARY OF 2023.

UM, ANY STANDS EARLY WILL ALLEVIATE A HEAVY WORKLOAD IN JUNE.

UM, COUSIN'S PAYROLL HAS ALREADY COMPLETED OURS, UM, TO HELP LIGHTEN THE LOAD IN THE UPCOMING MONTH.

UM, WE ARE A SMALL BUSINESS THAT SUPPORTS COMMUNITY AND WE HOPE THE COURT CAN SUPPORT US TODAY.

A COUPLE OF THINGS THAT I HEARD.

AND I DID WATCH THE MEETING THAT, YOU KNOW, HAPPENED A COUPLE OF WEEKS AGO.

ONE OF THE CONCERNS WAS, UH, ONE OF THE COMMISSIONERS TALKED ABOUT THE, THE MEDICINE DEBRIS IS LEFT BEHIND BY FIREWORK POPPERS.

AND I JUST WANT TO SAY THAT I, YOU KNOW, I CAN'T SPEAK FOR EVERYBODY, BUT THE ONES THAT I DO KNOW, WE DO WANT TO BE GOOD STEWARDS TO THE FIREWORK INDUSTRY.

AND AFTER HEARING THAT WE WILL DEFINITELY PUT SIGNS ON OUR DOORS AND EXPRESS TO PEOPLE TO PLEASE CLEAN UP AFTER YOURSELF THAT THIS STUFF COULD, AT SOME POINT IMPACT US BEING ABLE TO SELL FIREWORKS, YOU KNOW, LEAVING MESSAGES AND BEING A HINDRANCE TO THE COUNTY.

UM, ALSO I JUST WANT TO SAY LOOKING INTO IT, YOU KNOW, ME AND MS. BULLARD HAD BEEN COMING FOR THE LAST FIVE OR SIX YEARS TO GET THIS HOLIDAY PASS.

AND ALWAYS THE BIG DISCUSSION IS, YOU KNOW, WHETHER IT'S APPROPRIATE OR NOT ON MEMORIAL DAY.

AND, AND I TOTALLY RESPECT EVERYONE'S OPINION THAT WHAT MAKES UP OUR GREAT NATION HAS ALL THE DIFFERENT OPINIONS.

SO I JUST GOT ON GOOGLE LAST NIGHT AND THEY LOOKED AT A LITTLE BIT OF RESEARCH AND JUST BECAUSE I WANTED TO KNOW MYSELF, YOU KNOW, FOR SOMETHING I'M FIGHTING FOR, UM, SO MANY PLAYS, DALLAS SYMPHONY ORCHESTRA DOES A MUSIC AND FIREWORKS TO FOR MEMORIAL DAY TO CELEBRATE OUR VETERANS, UH, CORPUS CHRISTI, THE WOODLANDS IN TEXAS.

AND THAT BEING SAID, LIKE I SAID, I'M NOT AT ALL DISCOUNTED ANYBODY'S OPINION OR BELIEFS IN IT, BUT LIKE I SAID, THERE IS A LOT OF DIFFERENT OPINIONS AND I JUST PRAY THAT WE CAN COME TO A DECISION TODAY THAT HONOR ALL THEM OPINIONS AND THE FREEDOMS THAT OUR VETERANS FIGHT FOR.

UM, I SERVED 24 YEARS SO THAT EACH OF THE PEOPLE BEHIND ME WOULD HAVE A CHOICE TO MAKE, OR HAVE THE FREEDOM TO MAKE CHOICES THAT THEY WANT TO MAKE.

SO I CERTAINLY DON'T ENVY THE CHOICE OR THE DECISION THAT YOU HAVE TO MAKE ON A PERSONAL LEVEL.

UM, I DO NOT POP FIREWORKS AT A FUNERAL.

AND FOR ME, MEMORIAL DAY IS MORE OF A SOMBER HOLIDAY, A HOLIDAY TO GET TOGETHER WITH FAMILY AND LOVED ONES TO, TO GO TO CEMETERIES AND HONOR THE FALLEN WITH FLAGS AND YELLOW RIBBONS AND THINGS OF THAT NATURE.

UH, SO FOR ME, I DO NOT BELIEVE THAT MEMORIAL DAY IS A CELEBRATORY IN, IN THE, THE SAME NATURE THAT I WOULD SAY THE 4TH OF JULY OR SOME OTHER TYPE OF MAJOR, YOU KNOW, EXPLOSIVE, HAPPY CELEBRATION.

IT'S NOT A HAPPY DAY.

IT'S A SOMBER DAY.

IT'S A SAD DAY.

IT'S A DAY OF REFLECTION AND REMEMBRANCE.

SO, UH, THAT BEING SAID, I ALSO DID SOME RESEARCH.

AND AS THE GENTLEMAN POINTED OUT, THERE ARE SOME LARGER ORGANIZATIONS SUCH AS THE ONES HE MENTIONED THAT DO USE FIREWORKS AS A PART OF THEIR MEMORIAL DAY SERVICE AND CEREMONIES AND WHATNOT.

THERE ARE NONE, UM, AT THE CAPITOL, YOU KNOW, AT, AT BIG WHITE HOUSE, THERE'S, THERE'S NONE THERE.

UM, THERE'S NONE, UH, ON ANY MILITARY INSTALLATION THAT I HAVE EVER SERVED ON IN MY CAREER, WHICH HAS NUMEROUS, THAT HAS EVER USED FIREWORKS AS A MEANS OF HONORING OR CELEBRATING THAT HOLIDAY.

UM, AND WE DO DO EVENTS.

THEY JUST DON'T USUALLY INCLUDE THEY, THEY'RE MORE SOMBER, THEY'RE MORE REFLECTIVE, MORE REMEMBRANCE.

UM, THE CEREMONY WILL BEGIN AT 1100 AND WE'LL CONCLUDE IT SOMEWHERE BETWEEN 1145 AND 12 LUNCH WILL BE PROVIDED BY THE AMERICAN LEGION POST 1 65 HERE IN KAUFMAN.

UH, WE ENCOURAGE EVERYBODY TO COME OUT.

UM, WE HAVE A REALLY NICE GUEST SPEAKER LAID ON, AND I'M NOT GOING TO SPOIL THAT YET.

SO, UH, MORE THAN DOUBLED THE AMOUNT OF FIREWORKS CALLS, UM, AS FAR AS, UM, COMPARISON TO OTHER HOLIDAYS, MEMORIAL DAY HAS ALWAYS BEEN THE, UH, LOWEST AMOUNT OF FIREWORKS CALLS WITH THE EXCEPTION OF 2020.

WE ACTUALLY HAD MORE, UH, THE NEW YEARS THAT MAY BE WEATHER BASED.

I'M NOT SURE EXACTLY WHAT WEATHER CONDITIONS WE HAD DURING THAT TIME, BUT THAT WAS THE ONLY YEAR THAT WAS DIFFERENT.

UM, ALSO DID A COMPARISON OF JUST FIRE CALLS IN GENERAL.

UM, SINCE 2016, UH, MAY

BUT ONE OF THE BIGGER PITCHERS THAT WE DEAL WITH AS A FIRST RESPONDER IS THE FACT OF, I CAN TELL YOU THOSE ARE THE WORST TIMES THAT WE HAVE TO DEAL WITH US FIRST RESPONDERS, UM, ESPECIALLY IN COMMUNITIES THAT ARE OUT OF THE CITY LIMITS, BUT WITHIN THE COUNTY, WHILE THE HOA IS TELL PEOPLE THAT YOU CAN NOT BUY FIREWORKS IN THE COMMUNITY, BUT WE ALREADY KNOW PEOPLE, PEOPLE ARE GOING TO DO WHAT THEY WANT TO DO.

AND ONE OF THE BIG THINGS THAT WE DEAL WITH IS THEY POP FIREWORKS IN THE MIDDLE OF THE STREET.

UM, AND WE ALL KNOW WHAT GOES UP, MUST COME DOWN AND I CAN TELL YOU, AND ONE NIGHT WE CAN HAVE ALMOST 200 CALLS THAT HAVE TO DO WITH FIREWORKS.

AND WHEN THEY KNOW THAT THE OFFICERS ARE RESPONDING AND WE'RE TELLING THEM FIREWORKS, YOU'RE ALLOWED TO DO IT IN THE COUNTY.

THEN THEY START CHANGING THE FIREWORK CALLED THE GUNSHOT CALLS.

UH, WE WANT A SAFER COMMUNITY.

WE WANT PEOPLE TO MOVE HERE.

BUT THE LAST YEAR FIVE STATES WITH THE HIGHEST NUMBER OF OFFICERS SHOT IN THE LINE OF DUTY, WHERE TEXAS, CALIFORNIA, GEORGIA, AND FLORIDA, 24% OF LINE OF DUTY DEATHS WHEN TEXAS PEACE OFFICERS, THAT'S A QUARTER OF THE NATION WHERE TEXAS PEACE OFFICERS EVER KILLED.

YEAH.

SO SHOT AND KILLED SO FAR THIS YEAR, 101 OFFICERS, UH, SHOT THIS YEAR.

17 OFFICERS KILLED BY GUNFIRE.

32 OF THE OFFICERS WERE SHOT.

UH, 32 LAW ENFORCEMENT OFFICERS WERE SHOT 19 SEPARATE AMBUSH ATTACKS, NOT AMBUSH ATTACKS, EATING LUNCH, DOING REPORTS.

UH, THAT'S, THAT'S CRAZY.

UH, NUMBER, NUMBER OF OFFICERS SHOT IN THE LINE OF DUTY.

IT'S, UH, UP 63% FROM 2020.

AND THESE ARE JUST, UH, UH, THE COVID WAS IN THERE.

THAT'S JUST THE CHART.

I MEAN, I THINK ANY BUSINESS, ANY, ANY BODY IN AMERICA HAS LOST A LOT OF PEOPLE FROM COVID, BUT THAT, THAT SHOWS YOU, UH, GUNFIRE, AUTOMOBILE CRASH, VEHICULAR ASSAULT.

IT'S A SEVEN LAW ENFORCEMENT WHERE WE'RE INTENTIONALLY KILLED BY VEHICLES.

SO THESE ARE NATIONAL NUMBERS.

THE SHERIFF AND I WERE TALKING ABOUT, UM, THE ONLY DIFFERENCE THAT WE FOUND IS YOU SEE THE ELECTED CONSTABLES, THAT'S THREE THAT IS ELECTED CONSTABLES.

LIKE ONE OF US WE'RE THREE, THE DEPUTY CONSTABLES WE FOUND WHERE WE'RE LUMPED INTO THE 31 WHERE THE SHERIFF AND THE MUNICIPALITY.

SO I THINK THAT YOU'RE SEEING THREE ELECTED CONSTABLES AND NO ELECTED SHERIFFS BECAUSE THERE'S A LOT OF PART OF EAST, TEXAS IN WEST TEXAS THAT THEY ONLY HAVE A CONSTABLE.

SO MEANT TO THE DEATH.

AND, AND, UH, AND OF COURSE OUR NEIGHBORING COUNTIES ON THE OPPOSITE SIDE OF DALLAS COUNTY, THEY DO MATCH UP THE DALLAS COUNTY.

AND SO IT'S, IT GETS REALLY TOUGH FOR US EVEN ROCK WALL.

YOU KNOW, IF YOU LOOK AT ROCKWALL, YOU KNOW, THEY'VE STEPPED UP, YOU KNOW, THEY GO UP TO THE PLATE, YOU KNOW, AND, AND SHERMAN STEPS UP, YOU KNOW, BECAUSE THEY FACE THE SAME KIND OF PROBLEM THAT WE DO.

UM, I HAVE A MOTION COMING OUT OF EXECUTIVE SESSION.

MY MOTION FIRST, I WOULD PREFACE THE MOTION BY SAYING THAT THIS HAS TO DO WITH THE, UH, CHILDREN'S ADVOCACY CENTER OF KAUFMAN COUNTY.

THAT ORGANIZATION IS STATUTORY.

MEANING THE STATE LAW REQUIRES THAT WE HAVE THAT ORGANIZATION AND THAT THEY PROVIDE THE PUBLIC PURPOSE SERVICES THAT THEY DO.

MY MOTION IS THAT THE COUNTY ENTER INTO A 10 YEAR LEASE AGREEMENT ON THE, UH, BUILDING, WHICH WE'VE DISCUSSED IN, IN PREVIOUS MEETINGS, THEY WOULD HAVE A 270 DAY REVIEW DATE PRIOR TO THE END OF THE 10 YEAR LEASE.

UH, AT THAT END, AT THAT POINT, THE COMMISSIONER'S COURT COULD WITH THE AGREEMENT OF THE, THE ADVOCACY CENTER COULD AGREE TO EXTEND THE LEASE FOR ANOTHER 10 YEARS.

UM, AND THE AMOUNT OF THAT LEASE WOULD BE A HUNDRED DOLLARS A YEAR.

THERE IS INFORMATION IN THE PACKET THAT CAME IN, IN TODAY'S DISCUSSION THAT DESCRIBES THE VARIOUS RESPONSIBILITIES OF EACH PARTY.
