AND WE DO HAVE SOME DEFERRALS THAT ARE UNPAID.

AND SO THE CASE LAW THAT WAS CITED BY, UH, THE COUNTY SURVEYOR REFERS TO A CASE OUT OF THE SUPREME COURT, WHICH BASICALLY SAYS THAT THE GOVERNMENT HAS TO BE CAREFUL ABOUT WHAT THEY DECLARE TO BE WETLANDS.

IN OUR CASE, WE'RE NOT DECLARING ANYTHING TO BE WETLANDS.

WHAT WE'RE DOING IS WE'RE MERELY SUGGESTING THAT THE DEVELOPER OR PROPERTY OWNER GO AND CHECK THE WETLANDS MAP TO SEE IF THEIR PROPERTY FALLS WITHIN AN ALREADY DESIGNATED WETLAND AND THEN TAKE APPROPRIATE STEPS FROM THERE.

AND THE WAY I UNDERSTAND IT, THERE'S DIFFERENT CLASSES OF WETLANDS.

THERE ARE.

SO, UM, AND, AND, AND THEY'RE USING TEXAS PARKS AND WILDLIFE.

IS THAT THE ONLY, IT'S THE ONLY REFERENCE THAT THEY HAVE.

THE US PARKS, THE US PARKS AND WILD US PARKS AND WILD, I'M SORRY.

BECAUSE WHEN I WAS IN A MEETING LAST WEEK AND THE WAYLAND STILL CAME UP AND IT IS KINDA LIKE I WAS SCRATCHING MY HEAD AND I NEVER REALLY HEARD THAT DEALT WITH IN A DEVELOPMENT MEETING UNTIL THAT DAY.

AND THEN OF COURSE WE GOT THESE IN THE UPDATES AND STUFF.

SO, SO, BUT IT IS AN ACCURATE REFERENCE THAT, THAT THEY'RE UTILIZING.

IT'S A GOOD RESOURCE.

SO EVEN THE WETLANDS MAP THAT'S PROVIDED, NOT EVERYTHING THAT'S DESIGNATED ON THERE IS NECESSARILY WETLANDS IS JUST NOW CONSIDERED POTENTIAL WETLANDS.

AND THAT'S DUE TO SOME RECENT REVISIONS FROM COURT CASES.

SO THAT'S PART OF THE STRUGGLE IN DEFINING THE WETLANDS IS THAT THAT DOES CHANGE.

SO THE RECENT COURT CASE THAT WAS REFERENCED, SACKETT VERSUS E P A, DID CHANGE THAT DESIGNATION TO REDUCE THE AMOUNT OF AREAS THAT CLASSIFIES THAT.

SO THE COUNTY DOES NOT WANT TO MAKE ANY ATTEMPT TO DEFINE WHAT IS WETLANDS THAT'S OUTSIDE THE COUNTY'S AUTHORITY.

WE'RE NOT TRYING TO DO THAT AT ALL.

THE DEVELOPERS HAVE ALWAYS BEEN FEDERALLY OBLIGATED TO FOLLOW THE WETLANDS REGULATIONS.

WE JUST HAVEN'T MENTIONED IT BEFORE.

IT'S MORE OF A F Y I AS A COURTESY TO THE DEVELOPER TO LET THEM KNOW WE DON'T REGULATE THIS.

YOU DON'T HAVE TO PROVIDE ANY PROOF THAT YOU'VE GONE THROUGH AND GOTTEN A PERMIT OR TELL US IF IT IS OR ISN'T WETLANDS.

BUT JUST SO YOU KNOW, IF YOU LOOK AT THIS MAPPER AND YOU SEE THAT THERE'S A DESIGNATED POTENTIAL AREA ON YOUR PROPERTY, YOU SHOULD PROBABLY LOOK INTO THAT SO THAT YOU DON'T GET IN TROUBLE WITH THE E P A AND THE US ARMY CORPS OF ENGINEERS.

BASICALLY ALL WE'RE DOING IS MAKING THEM AWARE THAT THEY CORRECT.

IT MIGHT BE AT THEIR BEST INTEREST TO FOLLOW UP ON THIS JUST TO MAKE SURE THEY'RE IN THE CLEAR OR IF THEY TO DO SOMETHING.

AND THEN ON THE CHECKLIST, NOW THE ITEM THAT WE ADDED ON THERE THAT REFERENCES THE MAPPER, THAT'S JUST A CHECK BOX FOR THE DEVELOPER TO SAY, I'M AWARE THAT I SHOULD CHECK IF MY PROPERTY IS WITHIN WETLANDS OR NOT.

THIS MAPPERS A GOOD RESOURCE.

IF MY PROPERTY IS WITHIN WETLANDS, I PROMISE I'M GONNA GO DO WHAT I SHOULD DO.

AND THAT'S JUST A CHECK SOME BALANCES.

SO IF AT ANY POINT THE US ARMY CORPS OF ENGINEERS OR THE EPA A COMES OUT AND SEES SOMEONE'S FILLED OR EXCAVATED IN WETLANDS ILLEGALLY, AND THEN THAT DEVELOPER OR PROPERTY OWNER SAYS, OH, WELL I DIDN'T KNOW WHAT THE WETLANDS REGULATIONS WERE.

THEY DID NOT, THEN THE COUNTY HAS THIS DOCUMENTATION, WELL, YOU CHECK THIS BOX, WE'RE NOT REGULATING IT.

BUT THEN THAT KIND OF HELPS THE COUNTY ALSO LOOK OUT FOR THE E P A IN EXCHANGE.

'CAUSE IF SOMEBODY DOES THAT, THEY COULD BE POTENTIALLY POLLUTING THE WATERS IN KAUFMAN COUNTY, WHICH DOES AFFECT THE WHOLE COUNTY AND THE PUBLIC IN GENERAL.

SO WE CAN'T REGULATE THE WETLANDS, BUT WE CAN TRY TO DO OUR DUE DILIGENCE TO CHECKS AND BALANCE.

SAY, HEY, MAKE SURE YOU LOOK AT THIS.

AND THAT'S REALLY THE MOST THAT THE COUNTY HAS THE AUTHORITY TO DO.

CAN YOU SPEAK ON THAT WITH THE SEPTIC? SO I, I GUESS, I GUESS IT'D BE A SMART THING FOR THE, EITHER THE PARKS AND WILDLIFE OR THE FEDERAL GOVERNMENT OR SOMEBODY TO SAY, IF YOU'RE GOING TO BUILD IN THE AREA, YOU BETTER NOTIFY US AND WE'RE GOING TO NOTIFY THE COUNTY THAT YOU DID COME TO US AND YOU DID CHECK IT.

BUT THAT'D BE ON THEM.

IT WOULDN'T BE ON US.

BECAUSE WE HAVE NO AUTHORITY.

BUT IF YOU'RE CHECKING THAT THERE, IF THERE'S A WETLAND ON THERE AND ON THE MAPPER IT SAYS IT'S A WETLAND, THEN WE WERE TAKING THAT OUTTA THE NET OR TAKING IT OUT OF THE USABLE.

BECAUSE YOU CAN'T SPRAY IN THAT.

SO ONE OF THE PREVIOUS AMENDMENTS THAT WAS MADE KIND OF BETTER DEFINED WHAT COUNTED AS REQUIRING A DRAINAGE EASEMENT.

SO A STOCK POND FOR EXAMPLE, IF IT'S WITHIN JUST ONE PROPERTY AND IT'S NOT A PART OF A BIGGER DRAINAGE WAY, THERE'S NOTHING DRAINING TO OR FROM IT.

JUST AN ISOLATED POND ON ONE PROPERTY DOES NOT REQUIRE A DRAINAGE EASEMENT, BUT IT CANNOT COUNT AS USABLE SPACE.

IT DRAINS OFF INTO A CREEK OR YES SIR.

IT'S NOT IMPACTING ANY OTHER PROPERTY OWNERS.

IT'S JUST A STOCK POND RIGHT THERE.

NOT ALL DRAINAGE WAYS ARE WETLANDS, BUT ALL WETLANDS WILL BE SOME FORM OF A DRAINAGE WAY, WHICH MEANS THAT IT DOES REQUIRE A DRAINAGE EASEMENT.

SO WE DO NOT REQUIRE ANY DRAINAGE EASEMENTS FOR A WETLAND PER SE, .

BUT SINCE A WETLAND IS GOING TO BE A DRAINAGE WAY, IT WILL ALREADY HAVE AN EASEMENT ON THERE.

SO THAT'S A WAY TO KIND OF HELP SAFEGUARD THAT WITH TERMS OF USABLE SPACE.

SO, AND WOULD LIKE TO HAVE DONE MORE, BUT YOU KNOW, JUST, WE HAVE TO DO WHAT WE HAVE TO DO TO MEET THE STANDARDS AND THE LAW.
