I JUST WANT TO GIVE YOU A LITTLE HIGHLIGHT.

YOU KNOW, THE LAST COUPLE MONTHS HAS BEEN TOUGH ON LAW ENFORCEMENT IN THE STATE OF TEXAS.

UH, KIND OF GIVE YOU AN IDEA OF HELPING OUR AGENCIES, PARTNER AGENCIES FROM TERRELL TO KIND OF GIVE YOU AN IDEA OF WHAT WE DID FOR, FOR TERRELL AND WHAT WE'LL DO FOR ANY AGENCIES WHEN THEY ASKED.

BUT WE PROVIDED TERRELL WITH PATROL ON THEIR STREETS FOR 369 HOURS WITH 18 DEPUTIES .

SO HELPING THEM OUT.

OUR DISPATCH DIVISION, WE WOUND UP PROVIDING FOR COMMUNICATION OFFICER FOR OVER 51 HOURS IN DISPATCHING, UH, ELLIS COUNTY.

YOU KNOW, THEY HAD THAT TRAGEDY THERE.

WE SENT 22 DETENTION STAFF OVER THERE TO RUN THEIR JAIL AND THEIR OPERATION THE DAY OF THE FUNERAL.

SO WE SENT THEM FOR OVER THERE FOR ABOUT 10 HOURS.

SO KIND OF GIVE YOU WHAT WE'RE DOING TO HELP OUR FELLOW LAW ENFORCEMENT AGENCIES TO MAKE SURE THAT, YOU KNOW, I HOPE WE NEVER NEED IT DURING MY CAREER, THAT, BUT IF WE DO, WE HAVE PARTNER AGENCIES THAT'S GONNA HELP US.

SO JUST KIND OF GIVE YOU WHAT OUR COUNTY EMPLOYEES AND WHAT THEY'VE DONE AND STEPPED UP AND, AND DID FOR US.

YOU KNOW, THAT'S VERY IMPORTANT AND IT SHOWS SOLIDARITY BETWEEN THE UNITS, WHETHER IT BE IN OUR COUNTY OR THEIR NEIGHBORING COUNTY.

OUR INTEREST EARNED ON AT AMERICAN NATIONAL BANK WAS $1,684 292,538, UH, IN T POOL AND TEXAS CLASS FOR A TOTAL, UH, INTEREST EARNINGS FOR THE MONTH OF 294,000 2 23.

WE HAVE, UH, A TOTAL INVESTED, UH, AT THE END OF THAT MONTH OF $71,907,938.

OUR, UH, AVERAGE YIELD FOR THE MONTH IN SPOOL, 4.8324% AVERAGE YIELD IN TEXAS CLASS 4.8835%.

WE HAVE TOTAL FUNDS IN AMERICAN NATIONAL BANK AT THE END OF NOVEMBER OF 32,000,706.

VALUE OF THE COLLATERAL AT THE END OF THE MONTH, 62,000,768.

HE WANTS TO DISCUSS REINSTATING AN ASSISTANT PUBLIC DEFENDER POSITION, UH, THAT WE HAD SOME CHANGES ON FOR LAST OUR BUDGET YEAR AND LET 'EM MIX UP HERE.

UH, CORRECT.

AND, AND LET ME BE CLEAR, I MEAN, I'M ASKING THE COURT FOR A BUDGET AMENDMENT AS TO MY BUDGET, WHICH I KNOW IS NOT NORMALLY WELCOME THIS TIME OF YEAR.

BUT IF I COULD KIND OF GIVE YOU SOME BACKGROUND.

I KNOW COMMISSIONER PHILLIPS, JUDGE ALLEN SERVE ON MY OVERSIGHT BOARD, AND THEY MAY RECALL SOME OF THESE CONVERSATIONS.

UH, THE PREVIOUS YEAR WE HAD POSTED TWO POSITIONS AT ROUGH OR NOT ROUGHLY AN EQUAL SALARY.

UM, AND LITERALLY WENT THE BETTER PART OF A YEAR WITHOUT BEING ABLE TO FILL A POSITION FOR THE FIRST ASSISTANT PUBLIC DEFENDER, WHICH WE POSTED AS, UH, SOMEONE WITH A CERTAIN AMOUNT OF TRIAL EXPERIENCE THAT WOULD, THAT WOULD NOT BE AN ENTRY LEVEL POSITION, AND CANDIDLY DID NOT HAVE ANY CANDIDATES THAT FIT THE CRITERIA.

UH, WE HAD A PERSON THAT SHOWED SOME INTEREST, UH, BUT WE WERE GONNA BE ASKING HIM TO TAKE A PAY CUT.

AND SO WE ASKED OF THOSE TWO OPEN POSITIONS TO TAKE SOME OF THAT MONEY FROM ONE AND ADD IT TO ANOTHER SO THAT HE COULD COME OVER FROM ANOTHER JURISDICTION THAT ESSENTIALLY AN EQUAL PAY.

SO WE WERE ABLE TO HIRE THAT PERSON BACK IN AUGUST.

YES.

UH, HE'S WORKED OUT GREAT.

CAN'T SAY ENOUGH GOOD THINGS ABOUT THAT.

HE'S BOARD CERTIFIED IN CRIMINAL LAW, UH, SELF-STARTER AND HAS BEEN A HUGE ASSET TO OUR OFFICE.

BUT WHAT GOT LOST IN TRANSLATION IS WE WERE GOING TO LEAVE THAT REDUCED BALANCE AT ANOTHER POSITION THAT WE'RE GONNA BRING SOMEBODY IN AT MORE OF AN ENTRY LEVEL POSITION THAT'S BEEN POSTED.

UH, I BELIEVE SINCE JUNE OR JULY, WE HAVE A CANDIDATE THAT HAS ACCEPTED AN OFFER.

AND WHEN WE WENT THROUGH THE ORIENTATION PROCESS, IT CAME TO MY

ATTENTION THAT INSTEAD OF JUST REDUCING THAT, THAT POSITION WAS ELIMINATED, THAT WAS NOT OUR INTENT.

I'LL DEFER TO JUDGE ALLEN AND, UH, COMMISSIONER PHILLIPS.

I BELIEVE WE HAD THAT DISCUSSION IN ONE OF OUR BOARD MEETINGS.

YEAH, I'VE GOT A FALL ON THE SWORD.

THE OVERSIGHT WAS MINE NOT CATCHING THAT WHEN THE BUDGET WAS APPROVED.

OBVIOUSLY I WOULD'VE BROUGHT THAT TO EVERYONE'S ATTENTION SOONER.

UH, BUT WE'RE ASKING IS TO HAVE THAT POSITION REINSTATED SO, UH, THAT THE CANDIDATE WE'RE TALKING TO CAN BEGIN EMPLOYMENT WITH US AS AN ATTORNEY IN OUR OFFICER.

JUDGE GRAY, WOULD YOU LIKE TO COME ADDRESS THIS? I JUST, I CAME IN ON THE TAIL END OF, OF WHAT HE WAS SAYING, BUT THE, THE INDIGENT DEFENSE BOARD HAS, UH, TALKED TO, UM, MR. JORDAN ABOUT THE, THE THIRD POSITION.

I KNOW IT'S BEEN OPEN FOR A LONG TIME.

ORIGINALLY, WE HAD TALKED ABOUT HAVING TWO PEOPLE WHO MAY, MAY NOT BE AS COMPARABLE AS ANDREW, BUT INEXPERIENCED, BE ABLE TO HANDLE THE FIRST AND SECOND DEGREE FELONIES THAT, UM, WE'VE REQUIRED HIS OFFICE TO HANDLE.

AND WE'VE CHANGED THE PDS OFFICE IN THE LAST FEW YEARS.

I DON'T KNOW IF YOU WENT OVER THAT, BUT IN ORIGINALLY IT WAS HANDLING ALL DIFFERENT KINDS OF CRIMINAL CASES.

IT NOW EXCLUSIVELY HANDLES FIRST AND SECOND DEGREE FELONIES BECAUSE THOSE COST THE COUNTY THE MOST AMOUNT OF MONEY.

THERE ARE LESS CASES, BUT THOSE CASES ARE VERY EXPENSIVE.

AND WITH A FIXED COST, IT MAKES SENSE FOR THEM TO BE ABLE TO HANDLE THAT AMOUNT.

AND ONE OF THE THINGS THAT WE'RE ALSO ASKING HIS OFFICE TO LOOK INTO IS, UH, TO BECOME CAPITAL CERTIFIED SO THAT THEY CAN START TAKING ON THAT LOAD FOR FUTURE.

HOPEFULLY WE DON'T HAVE ANY MORE OF THOSE CASES, BUT IF WE DO, THAT'S SOMETHING HIS OFFICE CAN MAYBE HANDLE AS A SECOND DEGREE.

I'M SORRY, AS A SECOND CHAIR AND EVENTUALLY MAYBE A FIRST CHAIR.

BUT THE THIRD POSITION, WHAT HE AND I HAD TALKED ABOUT PRIVATELY AS WELL, WAS HE DIDN'T NECESSARILY NEED AS HIGH A SALARY RATE AS, I BELIEVE IT'S LEAST IT IS TYLER IN YOUR OFFICE, RIGHT? CORRECT.

UM, SOMEONE ELSE THAT CAN BE TRAINED, UH, YOU DON'T HAVE, THE COUNTY WOULDN'T HAVE TO PAY THAT PERSON AS MUCH RIGHT NOW, UM, WHILE TYLER AND ANDREW ARE TRYING A CASE IN ONE COURT, YOU'D HAVE THE THIRD ATTORNEY TAKING PLEA IN ANOTHER COURT, SOMETHING LIKE THAT.

SO IT WOULDN'T HAVE TO BE THE SAME EXPENSE.

UM, AND I UNDERSTAND THAT.

I HAD HEARD FROM JUDGE ALLEN THAT Y'ALL WERE LOOKING AT ELIMINATING THAT POSITION JUST 'CAUSE IT HADN'T BEEN FILLED IN A WHILE.

AND I THINK YEAH.

LONG TIME.

YEAH.

CORRECT.

AND I, I THINK THAT'S WHERE IT, IT CAME ABOUT.

BUT THE, THE NEED IS GOING TO BE WITH THE GROWTH OF THE COUNTY WITH, I, I THINK I TALKED TO LISA, WE'VE HAD MORE COURT APPOINTED CASES STARTING LAST JULY THAN WE'VE EVER HAD.

AND WE WANT TO UTILIZE THEIR OFFICE ON THOSE FIRST AND SECOND DEGREES BECAUSE THOSE ARE THE MOST EXPENSIVE CASES, CRIMINAL CASES THAT OUR COUNTY HANDLES.

AND SO WITH THEIR COSTS BEING FIXED, THE MORE EXPENSIVE THINGS THAT THEY CAN HANDLE FOR THE COUNTY, THE BETTER OFF THE COUNTY WILL BE.

AND THAT'S WHAT THAT THIRD POSITION WILL DO.

AND YOU KNOW, UH, WE HAD TO GET ANOTHER EMPLOYEE FOR LISA BECAUSE WE DID WHICH VOLUME? SAME, WHICH JUST SHE COULDN'T DO IT IN A TIMELY MANNER THAT'S REQUIRED BY LAW.

CORRECT.

AND WITH THE POPULATION CHANGING, OUR REQUIREMENTS WILL CHANGE WHEN WE GET TO A POPULATION OF 225,000 INSTEAD OF A THREE DAY LAG TIME.

IT'S A 24 HOUR LAG TIME FROM WHEN AN, UH, AN ATTORNEY HAS TO BE APPOINTED.

AND WE WANNA BE AHEAD OF THAT AND HAVE SOMEONE TRAINED.

AND IT WAS ALREADY GETTING TO THE POINT LISA WAS WORKING THROUGH HER THANKSGIVING BREAK.

YEAH.

SHE WAS COMING UP HERE ON WEEKENDS.

SHE WAS TRYING NOT TO TELL ANYONE.

AND SHE WASN'T ACTUALLY GETTING PAID FOR SOME OF THESE HOURS.

AND PART OF THAT RE PART OF THE WAY WE GOT HELP IS ACTUALLY FROM THE PDS OFFICE BECAUSE OF THE, UH, I DON'T KNOW IF IT WAS THAT SALARY OR A DIFFERENT SALARY THAT WAS ALSO USED FOR THAT.

AND SO, UH, AND THAT WAS ANDREW ACTUALLY ANDREW'S IDEA THAT HE SHARED IN THAT COST.

HE SHARED THE COST OF THAT.

WELL, THAT'S THE SERIOUS ISSUE, THE CONSTITUTIONAL OBLIGATIONS WE HAVE.
