CONSIDER AN APPEAL OF SUBDIVISION VARIANCE DECISION MADE BY THE DEVELOPMENT SUPPORT COMMITTEE FOR THE ENCHANTED OAKS, UH, PROJECT FOR SECTION 13.01, 1.1 OF THE SUBDIVISION REGULATIONS.SO THE DEVELOPMENT SUPPORT COMMITTEE CONSISTS OF FIVE DIFFERENT MEMBERS.
WE HAVE FOUR REPRESENTATIVES FROM DIVISIONS, VARIOUS DIVISIONS WITHIN THE DEVELOPMENT SERVICES DEPARTMENT, AND WE ALSO HAVE A REPRESENTATIVE FROM, FROM THE FIRE MARSHAL'S OFFICE.

SO CHINA OAKS IS A, UH, 530 ACRE PROPERTY LOCATED AT, AT THE INTERSECTION OF 27 28 AND 3 46.
UM, OUR DEVELOPMENT IS WHAT'S REFERRED TO AS A LARGE LAW DEAL, UH, MEANING THAT WE'RE NOT BUILDING, YOU KNOW, YOUR 50 FOOT BY ONE 20 FOOT LOSS, YOU'RE BUILDING, UM, AT LEAST A ACRE AND A HALF TO SIX ACRES.
IT'S OUR LAYOUT YIELD'S ABOUT TWO, THREE LOTS.
AND LIKE I SAID, THEY'RE BETWEEN ONE AND A HALF AND SIX ACRES LONG OR LARGE.
UM, OUR CONSTRUCTION CONSISTS OF ONLY ASPHALT ROAD INSTALL, ROAD, UH, WATER INSTALL, AND THEN UNDERGROUND POWER INSTALL AS WELL.

SO EACH SHEET SHOWS A DIFFERENT ROAD AND IT SHOWS THE PROFILE ITSELF AND THE GRADING OPERATIONS ON THE PLAN VIEW.
AND ALSO ON THE PLAN VIEW, IT IS THE 40 SCALE, WHICH IS WHAT THE, UH, STANDARDS ASK FOR ON GRADING SHEETS.

YES, BRAIDING, WE HAD AN ISSUE WITH THIS COUPLE YEARS BACK WITH A SUBDIVISION IN TERRELL THAT THEY DIDN'T DO THE GRADING AND IT DIDN'T, IT AFFECTED ALL THE DOWN WATER STREAMING AND THE FLOODING WITH ALL THESE PEOPLE WATERING THEIR HOUSES.
SO I'M ASSUMING THAT'S WHY WE ASKED FOR THAT, RIGHT? FOR THE COMPLETE GRADING, BECAUSE WE HAD AN ISSUE WITH SOMETHING SIMILAR TO THIS COUPLE YEARS BACK.
THAT'S WHY THE REGS JUST LAY OUT THAT GRADING AND DRAINAGE PLANS ARE REQUIRED FOR THE PRELIMINARY REVIEW PROCESS.
AND THESE ARE THE REQUIREMENTS FOR THOSE PLANS.
UM, SO THE TECHNICAL MEMO FROM THE ENGINEER JUST

AND, UH, MR. MOORE, JUST LIKE TO LET YOU KNOW, WE, WE DID A FLOOD STUDY FOR THIS PROJECT, UM, THAT ENCOMPASSES THE ENTIRE GRADING OPERATION AND IT PROVED THAT THERE'S NO DOWNSTREAM EFFECTS, UM, OF THE FLOODPLAIN AWAY FROM OUR PROJECT.
UM, SO WITH THAT, THAT'S NOT IN THE CIVIL PLANE SET, BUT THAT FLOOD STUDY ENCOMPASSES ALL OF OUR GRIDING OPERATIONS AND PROPOSED CONTOURS AND IT PROVES THAT THERE'S NO DOWNSTREAM EFFECTS OUTSIDE OF OUR DEVELOPMENT.
JUST KINDA GIVE YOU MORE CLARITY ON THAT.
UM, SO ANOTHER POINT, UH, IS THAT THESE, SO ALSO YOU CAN SEE THERE'S TO BE 34 GRADING SHEETS THAT WE WOULD ADD INTO OUR PLAN SET.
UM, OUR BELIEF IS THAT THESE SHEETS WOULD NOT BE USED DURING CONSTRUCTION.
UM, ALL THE PAVING SHEETS THAT ARE ALREADY IN THE PLAN SET SHOW THE SUFFICIENT INFORMATION.
AND I UNDERSTAND THAT 40 SCALE GRADING SHEETS ARE NEEDED FOR THESE SORT OF DEVELOPMENTS.
UM, LIKE I HAVE SPENT SIX YEARS DOING ENGINEERING, UH, FOR A FIRM IN NORTH DALLAS.
I SPENT MANY, MANY HOURS, UH, PAINSTAKINGLY HOURS OVER CREATING THESE SORT OF DEAL, THESE SORT OF PLAN SETS, UH, FOR MASTER PLAN COMMUNITIES, RIGHT? BUT THOSE, THOSE COMMUNITIES ARE DEALS WHERE THE DEVELOPER HAD HIGH DENSITY PRODUCT, MEANING THAT THEY PUT IN AS MUCH HOUSES AS THEY COULD.
UH, WE'RE NOT DOING THAT HERE.
WE WANT TO GIVE FAMILIES OPPORTUNITY TO HAVE A FEW ACRES OUTSIDE THE CITY WHERE THEY CAN COME WITH THEIR FAMILIES AND BUILD THEIR OWN PRODUCT ON THEIR OWN LAND.
UM, SO I THINK THROUGHOUT CONSTRUCTION, UH, THE INNING CONTRACTOR WON'T NEED TO BUILD UP ANY PATHS WHATSOEVER.
THEY'LL BE DOING JUST THE GRINNING OF THE, OF THE ROAD AND THE DITCHES.
UM, AND THEY WON'T BE DOING ANY SORT OF IMPROVEMENTS TO THE LOTS THEMSELVES.
UM, SO TO KINDA SUMMARIZE ALL THAT INTO A FEW, A FEW POINTS, UH, WE BELIEVE THAT ADDING THESE GRADING SHEETS TO THE PLAN SET WOULD ADD HARDSHIP, UH, TO THE DEVELOPER.
THE TIME, MONEY, AND OVERALL EFFORT IT WOULD TAKE TO ADD THESE SHEETS IS PRETTY SUBSTANTIAL.
UM, NUMBER TWO, UH, LIKE I SAID, I THINK THERE'S NO NEED FOR THESE GRADING SHEETS DURING CONSTRUCTION.
LIKE I SAID, UH, THEY'LL BE USING JUST THE PAVING SHEETS FOR THE PROFILE AND FOR THE BAR DITCHES.
AND IN THE END AS DESCRIBED TODAY, UH, WE DON'T THINK THAT THESE GRADING SHEETS WOULD ADD ANY INFORMATION THAT'S NOT ALREADY ON OUR PLAN SET.
UM, SO THAT'S MY, THAT'S MY PITCH.
UH, ANY QUESTIONS, UH, FROM THE COMMISSIONERS OR JUDGE? WELL, I THINK WE'RE TRYING TO PROTECT THE FUTURE.

AND SO THEN YOU SAID STATED THAT THE COUNTY WILL COME OUT AND INSPECT EACH LOT ON THE GRADING.
AND I DON'T, WE HAVEN'T BEEN DOING THAT.
I MEAN, I DON'T KNOW THAT WE CAN GO OUT AND WE DON'T DO THAT.
WE DON'T, WE CAN'T GRADE EVERY LOT AND WHERE'S THE WATER GOING? NO, I'M SORRY.
THERE'S NO INSPECTIONS TO BE DONE BY THE COUNTY.
I MEANT THAT IF A LANDOWNER COMES IN HERE AND WANTS TO BUILD A HOME RIGHT ON THEIR LOT, IF THEY HAVE TO GET A BUILDING PERMIT OR, UM, F WELL I UNDERSTAND, BUT YOU'RE SAYING GET A BUILDING PERMIT AND THEN WE'RE GONNA DECIDE IF THEY'RE GONNA FLOOD THE NEXT LOT.
AND I THOUGHT THAT WE WERE TRYING TO FIGURE OUT A WAY IN OUR DEVELOPMENTS THAT PEOPLE DON'T FLOOD OTHER PEOPLE LOTS.
SO ONE THING THAT YOU'RE NOT GRADING THE INTERNAL PART, CORRECT? YES SIR.
SO THE, SO WE DON'T KNOW WHERE THE WATER FLOW IS GOING.
SO I THINK ONE THING THAT WE COULD HAVE CLARIFIED ON OUR PLAN SET FROM THE VERY BEGINNING IS THAT THE DRAINAGE SWELLS BETWEEN THE LOTS ARE GONNA BE COMPLETELY ON THE LANDOWNER WHENEVER THEY BUILD ANYTHING ON THEIR PROPERTY, IT'S, IT'S WITHIN, IT'S THEIR RESPONSIBILITY TO INSTALL THE, THE, THE DRAINAGE RAILS BETWEEN THE LOTS SO THAT THE LOT TO LOT DRAINAGE DOES NOT HAPPENING.

THE GRADING AND DRAINAGE IMPROVEMENTS ARE THE RESPONSIBILITY OF THE DEVELOPER AND THEY NEED TO BE SHOWN IN THEIR CIVIL PLANS.AND FOR THOSE PLANS TO BE RE BE APPROVED BY THE CONSULTING ENGINEER, THEY HAVE TO BE ON THERE.
AND THEN THERE WILL BE AN INSPECTION ONCE THAT CONSTRUCTION IS DONE TO CONFIRM THAT THAT GRADING AND AND DRAINAGE WORK IS, IS GOING TO MATCH THE PLANS THAT WERE APPROVED.

UH, AND THEY HAVE TO AGREE TO THAT AND SIGN IT, UH, BEFORE THEY BUY THE PROPERTY.

AS YOU KNOW, WE'RE NOT THAT OLD.
WE DON'T HAVE A LOT OF RESOURCES.
WE DON'T YET HAVE A, UH, CITY PROPERTY TAX.
SO OUR FUNDS ARE VERY LIMITED.
AND QUITE HONESTLY, IF IT WEREN'T FOR YOUR SUPPORT THROUGH THE ILA SHERIFF CONSTABLE AND OTHERS, WE WOULD BE IN BAD SHAPE.
SO WE VERY, VERY MUCH APPRECIATE DURING THIS KIND OF MATURING PHASE OF OUR TOWN AS WE KIND OF GET UP AND RUNNING AND FIGURE OUT, YOU KNOW, WHAT WE NEED TO BE DOING.
UM, HAVING YOU GUYS AND, UH, LIKEWISE OVER IN HUNT COUNTY, COMMISSIONER MONROE, AND BY THE WAY, KELLY AND DAVID WORK VERY, VERY WELL TOGETHER.

THE MONEY WAS THERE, WAS SET UP, IT WAS NEVER USED.
