UH, FIRST ORDER OF BUSINESS IS IF YOU WILL STAND, WE'RE GOING TO HAVE AN INVOCATION LED BY COMMISSIONER KATE.

THIS IS TO RECEIVE INPUT FROM THE PUBLIC REGARDING PLACING NO PARKING SIGNS ON COUNTY ROAD THREE 19 IN KAUFMAN COUNTY PRECINCT THREE, UH, GIVE US A LITTLE UPDATE.

WE'VE HAD A LITTLE SITUATION ON A COUNTY ROAD THREE 19, UH, JUST EAST OF, UH, LET'S SEE, THAT'D BE JUST EAST OF, UH, 34.

UH, THEY BUILT SOME NEW HOMES THERE.

UH, SEVERAL OF THEM IN A ROW AND IT'S CALLED THE PARKING SITUATION.

UH, WHERE A RANCHER OVER THERE, MR MCFARLANE IS UNABLE TO GET HIS CATTLE IN AND OUT, BUT BECAUSE OF ALL THE VEHICLES PARKED ALONG THE ROAD AND IN HIS DRIVEWAY, AND SO, UH, TO MAKE IT EASIER FOR OUR LAW ENFORCEMENT TO ENFORCE, UH, OVER THERE AND THEY'LL PARK AND I WANTED TO RECOMMEND US PUTTING THE SIGNS UP SO WE NUMBER ONE TO ONE THAT WAS FOLKS AND NUMBER TWO SO WE CAN ACTUALLY DO SOME ENFORCEMENT ACTION ON IT.

UM, SPECIFICALLY THE CHANGES ARE, UM, WHO IS ABLE TO WORK ON THEIR OWN SEPTIC SYSTEM.

UM, UH, ALSO THE, UM, WE WANT TIMERS ON THEM FOR THE PUBLIC SAFETY.

THEY GO OFF AT A CERTAIN TIME AND THEN WE'VE CONDENSED SOME OF THE WORDING.

SO, UM, EVERYTHING ELSE IS PRETTY MUCH THE SAME EXCEPT FOR H THROUGH K.

THIS, THIS IS A PUBLIC HEARING REGARDING TO RECEIVE INPUT FROM THE PUBLIC REGARDING REVISIONS TO KAUFMAN COUNTY'S SUBDIVISION AND LAND DEVELOPMENT REGULATIONS.

DO YOU WANT TO GIVE US A LITTLE BRIEF ON THAT PLEASE? OKAY.

SO YEAH, AS YOU KNOW, UM, AND EVERYBODY KNOWS THAT KAUFFMAN HAS EXPERIENCED MAJOR GROWTH.

OUR REGULATIONS WERE, UM, WE WERE OPERATING OFF 2006.

THOSE WERE NOT, UM, GIVING US WHAT WE NEEDED TO MAKE SURE THAT THE CITIZENS WERE PROTECTED.

AND SO WE HAD TO DRAFT NEW ONES.

DANIEL AND ELIANA FROM FREESE AND NICHOLS HAVE BEEN HELPING US FOR ALMOST TWO YEARS TO DRAFT THIS NEW REGULATION AND NOW IF THEY CARE TO SPEAK ON IT OR IF NOT, IF SOMEBODY HAD ANY QUESTIONS PERTAINING TO THAT, THEY COULD.

BUT, UM, THESE WERE VERY NECESSARY.

UM, WE HOPEFULLY HAVE COVERED THE MAJORITY.

IT'S NOT GOING TO BE PERFECT BECAUSE THERE'S ALWAYS THOSE GRAY AREAS, BUT WE THINK WE'VE GOT A REALLY GOOD SUBDIVISION REGULATIONS THAT'S GOING TO HELP US MOVE TO THE FUTURE WITH ALL THE GROWTH THAT'S COMING.

SO THIS IS A PUBLIC HEARING TO RECEIVE INPUT FROM PUBLIC WRITING REVISIONS TO THE KAUFMAN COUNTY SUBDIVISION AND LAND DEVELOPMENT REGULATIONS.

MY NAME IS MICHELLE SHERVIN.

I'M WITH STATEWIDE SERVING AND KAUFMAN AND UM, I'VE APPRECIATED ALL THE HARD WORK THAT HAD BEEN PUT INTO CREATING THE SUBDIVISION REGULATIONS WE WERE IN NEED OF WITH THE GROWTH COMING WE WERE IN NEED OF HAVING MANY THINGS ADDRESSED IN THE COUNTY.

UM, WELL I, AND COMPLETELY IN FAVOR OF CHANGES BEING MADE.

UM, MY COMMENTS ARE STRICTLY TO ENCOURAGE YOU AS COMMISSIONERS AND UM, YOU AS COUNTY JUDGE TO JUST HAVE SOME OPEN DISCUSSION DURING THE PUBLIC HEARING.

MAYBE, UM, ASK QUESTIONS OF EACH OTHER OR ASK QUESTIONS OF MONIQUE SO THAT MAYBE IT CAN BETTER INFORM THE PUBLIC AND CAN INFORM, UM, OTHER LEADERS IN THE INDUSTRY, IN THE SURVEYING INDUSTRY AND THE TITLE COMPANY INDUSTRY AND THE LENDING INDUSTRY TO BETTER BE ACQUAINTED WITH THINGS THAT ARE COMING THAT ARE DIFFERENT THAN WHAT WE HAVE IN PLACE RIGHT NOW.

UM, BECAUSE THERE ARE GOING TO BE NUMEROUS CHANGES TO THE POTTING INDUSTRY AND IT'S GOING TO CHANGE ENTIRELY HOW WE APPROACH THINGS.

UM, ONE OF THE FIRST THINGS WILL BE WHEN A CLIENT COMES INTO OUR OFFICE RATHER THAN SITTING DOWN AND HAVING DISCUSSIONS ABOUT OPTIONS FOR DEVELOPMENT.

UM, AND HOW WE CAN BEST SERVE THEM WANTING TO CUT UP A PIECE OF PROPERTY.

OUR, OUR, OUR NEXT STEP WILL PROBABLY BE TO SEND THEM TO MONIQUE FIRST BECAUSE THEY ARE, THEY'RE GOING TO BE A LOT OF UNIQUE SITUATIONS.

UM, THERE ARE A LOT OF ODD SHAPED TRACKS.

THERE ARE A LOT OF FLOODPLAIN AREAS.

UM, AND ALL OF THOSE WILL BE NOW ADDRESSED DIFFERENTLY THAN WE WOULD HAVE JUST APPROACHED DEVELOPMENT IN THE PAST.

UM, SO, SO I JUST ENCOURAGE YOU TO, UM, ASK QUESTIONS OF EACH OTHER, OF MONIQUE, OF UM, REBECCA AND KAREN SO THAT EVERYONE CAN GET A BETTER UNDERSTANDING OF THIS.

MY OTHER COMMENT WOULD BE BECAUSE THERE ARE SO MANY CHANGES AND BECAUSE OF THIS WILL CHANGE THINGS FOR ALL OF US IN HOW WE PROCEED WITH CLIENTS.

UM, BUT I HIGHLY ENCOURAGE YOU AS COMMISSIONERS

WITH YOUR CONSTITUENTS AND I HIGHLY ENCOURAGE DEVELOPMENT SERVICES THAT YOU ARE SUPPORTIVE OF THEM AND THAT YOU GUYS ALL GET OUT THERE AND HELP PROVIDE EDUCATION FOR HOW WE ALL ARE GOING TO PROCEED BECAUSE THERE ARE JUST SO MANY QUESTIONS.

YOU KNOW, I HOPE THAT THAT IT CAN BE IN A FORUM STYLE WHERE PEOPLE CAN ASK QUESTIONS SO THAT WE CAN, WE CAN BETTER EDUCATE OURSELVES ABOUT HOW WE PRESENT A PLAT TO YOU, UM, OR HOW A TITLE COMPANY WILL APPROACH DIVIDING UP A PROPERTY FOR A FAMILY.

UM, OR, OR THINGS LIKE THAT BECAUSE IT'S JUST GONNA CHANGE THINGS.

SO, UM, BASICALLY THE BIGGEST THINGS I WOULD ENCOURAGE YOU TO DISCUSS IN THE PUBLIC HEARING WOULD BE, UM, THE NEW DEVELOPMENT SUPPORT COMMITTEE AND HOW THAT ROLE WILL AFFECT WHAT YOU GUYS DO.

UM, AND HOW DEVELOPERS WILL ASK FOR, UM, WAIVERS OR HOW THEY CAN CONDUCT DEVELOPMENT.

UM, FAMILY PARTITIONS ARE A BIG THING.

THERE'S GOING TO BE A NEW AFFIDAVIT THAT WILL NEED TO BE SIGNED.

THAT'S SOMETHING THAT PEOPLE DON'T KNOW ABOUT THAT WILL NEED TO BE DISCUSSED AND, AND EDUCATED.

UM, DIRECT LOT FRONTAGE.

THAT'S GOING TO BE IMPORTANT BECAUSE THAT'S GOING TO DECIDE HOW WE DIVIDE PIECES OF PROPERTY IN THE SERVING INDUSTRY.

UM, PRE-DEVELOPMENT MEETINGS THAT, THAT WE WILL NOW ENCOURAGE CLIENTS TO GO TO DEVELOPMENT SERVICES AND DISCUSS HOW THEY'RE GOING TO CUT UP A PIECE OF PROPERTY RATHER THAN STARTING WITH US.

UM, ACCESS EASEMENTS VERSUS INFRASTRUCTURE, WHETHER THOSE THINGS ARE GOING TO BE ABLE TO HAPPEN OR IF, IF THEY WEREN'T, BUT HAVE THE OPTION TO THEN HOW THOSE WOULD BE APPROACHED, UM, FLED DEVELOPMENT, UM, THAT WILL NOW REQUIRE PERMITTING AND POSSIBLE FLOOD STUDIES.

AND THEN ALSO THE THOROUGHFARE DEDICATION BECAUSE WE NEED TO MAKE SURE THAT THOSE THINGS ARE HAPPENING WITH OUR, AND SO WITH THAT BEING A REQUIREMENT, WE WANT TO MAKE SURE THAT THE INDUSTRY UNDERSTANDS, UM, HOW THAT'S APPROACHED AND WHAT KIND OF, UM, SETBACKS AND THINGS LIKE THAT ARE APPLIED.

THE PURPOSE OF IT COMING THROUGH THE ONE STOP SHOP, THE DEVELOPMENT FIRST IS SO THAT WE CAN SEE ANY POTENTIAL PROBLEMS THAT COULD ARISE DOWN THE ROAD.

SO IT'S BENEFICIAL FOR ALL INCLUDING SOME OF THE BUSINESSES THAT WORK TO KNOW WHAT IS GOING TO BE REQUIRED SO THAT YOU'RE NOT MAKING THREE AND FOUR DIFFERENT SURVEYS.

YOU'RE GOING TO KNOW OFF THE BAT WHAT YOU'RE GOING TO DO.

UM, THE FLOOD ORDER, THE PERMIT HAS BEEN IN PLACE ALREADY.

THAT'S JUST, YOU KNOW, GOING TO JUST, IT'S JUST BEEN UPDATED TO, UM, ADD THE COMMON VISION LANGUAGE SINCE WE ARE NOW PART OF THAT TASK FORCE THAT HAD TO BE ADDED TO THE FLOOD ORDER.

SO THE PROCESS OF A MEET AND GREET IS TO EDUCATE ONSITE RIGHT THEN AND THERE.

SHOW US WHAT YOU WANT TO DO.

WE'RE NOT HERE TO STOP DEVELOPMENT.

WE JUST WANT TO MAKE SURE THAT IF YOU WANT TO WILL THIS TO YOUR KIDS IN THE FUTURE.

THEY HAVE A CLEAN TITLE THAT IT'S DONE PROPERLY.

AND YOU KNOW, I'VE HAD SEVERAL PHONE CALLS ALREADY THAT SAID, HOW LONG DOES IT HAVE TO STAY WITH THE FAMILY? SO THERE'S ALREADY THAT I'M GOING TO SAY IT'S FOR A FAMILY AND THEN DO THEY HAVE TO KEEP IT FOR ONE YEAR AND THEN THEY CAN SELL IT.

SO YOU KNOW, WE HAVE TO AT LEAST, UM, UM, EDUCATE THEM AND TRY TO TAKE CONTROL OF THE LAND BECAUSE HE HAS GOTTEN OUT OF HAND.

AND THE ONLY WAY WE CAN DO THAT IS MEET WITH US.

AND PRIOR TO THAT, WE DIDN'T HAVE ANY CENTRAL PLACE FOR PEOPLE TO GET INFORMATION IF THEY WERE GOING TO DO DEVELOPMENT OR TRY TO SUBDIVIDE A PIECE OF PROPERTY.

THEY DIDN'T, YOU KNOW, THEY WENT TO THE COMMISSIONERS AND I GUESS IT WASN'T A VERY, UH, WHAT WENT ON IN ONE PRECINCT MIGHT NOT BE THIS THE AUNT'S, SAME ANSWER THEY GOT IN ANOTHER PRECINCT.

SO, UH, THIS WASN'T CONSISTENT SO THEY DIDN'T KNOW WHAT TO DO.

AND SO THAT'S A REALLY GOOD THING AND I KNOW THAT THIS HAS BEEN A LONG, LONG PROJECT,

MOST ESPECIALLY, WE HAVE NOT BEEN ABLE, IT'S NOT BEEN EASY.

WE HAVEN'T BEEN ABLE TO COMPARE VERY WELL TO OUR SURROUNDING COUNTIES BECAUSE OUR SURROUNDING COUNTIES HAVE NOT REVISED THEIR CODES.

AND MORE, ESPECIALLY THOSE THAT MAY HAVE REVISED UP TO THE 2012 EDITION, UH, HAD NOT REVISED THEIR FEE SCHEDULES AT ALL.

AND WE GOT THE NOTICE IN THAT THE STARTING IN 2015 THE CODE, ACTUALLY, THE LANGUAGE IN THE CODE CHANGED.

IT CREATED, UH, THE BUILDING PERMIT ITSELF, PLACED IT UNDER THE BUILDING CODE AND THEN THE, UH, OPERATIONAL PERMITS WERE CREATED.

UH, THE CONSTRUCTION WERE CREATED UNDER THE FIRE CODE AS WELL AS WE STILL DO OUR FIRE AND LIFE SAFETY PERMITS FOR STATE LICENSE FACILITIES.

SO A LOT OF TIME GOING BACK AND FORTH PLAYING IN INTO THE LANGUAGE.

UH, SO, UH, ONE OF THE FIRST THINGS I DID WAS REBUILT THAT ROAD AT A COST OF ABOUT $230,000.

THEN THE RAINS CAME AND, UH, WE FOUND THAT THERE WAS A SERIOUS FLOODING PROBLEM ON THAT ROAD.

THAT'S WHY IT HAD BEEN JUST LEFT FOR YEARS.

SO, UH, WITH THAT IN MIND, A GENTLEMEN NAMED RONNIE HAMILTON WHO OWNS TERRELL SANDPIT, UH, WHICH IS DOWN AT THE, UH, THE NORTH END OF THAT ROAD, HE, UH, OFFERED TO HIRE AN ENGINEER AND BRING HIM IN TO FIND OUT WHY THERE WAS SUCH A FLOODING PROBLEM WHERE IT WAS COMING FROM AND WHAT COULD BE DONE TO CORRECT IT.

AND SO, UH, HE WANTS TO DO THAT.

AND THEN ONCE THAT IS DETERMINED, HE ALSO WANTS TO, UH, DONATE ALL THE MATERIALS FOR THE ROAD TO BE FIXED PROPERLY AT THE AFTER THAT HAPPENED.
