UH, BECAUSE THERE ARE QUESTIONS THAT, UH, THE CITY HAS REGARDING THE PROCEDURAL AND SUBSTANTIVE REQUIREMENTS OF THE TAX CODE AND OTHER STATUTORY, UH, PROVISIONS AND WHETHER THOSE HAVE BEEN COMPLIED WITH, UH, PRIOR TO THE TIME THAT THIS HAS COME BEFORE A OVER THIS COURT HERE TODAY.

THESE TODAY, MS. SANDERS, FOR A LONG TIME, THE CITY OF TERRELL HAS, UH, ESTABLISHED A TRACK RECORD, I THINK, OF BRINGING OUTSTANDING, UH, OPPORTUNITIES TO THE COUNTY, UH, OPPORTUNITY TO GENERATE ADDITIONAL SALES TAX.

I'M GONNA JUMP INTO OUR ADDITIONAL PROPERTY TAXES AND, UH, AND I THINK THAT OUR TRACK RECORD STANDS THERE.

WE HAVE WORKED, WE STARTED A LONG TIME AGO, UH, WORKING ON THIS TIP.

UH, WE'VE ENGAGED, UH, ONE OF THE PREMIER, UH, CONSULTING FIRMS IN THIS BUSINESS, UH, SCHREYER AND KLEIN.

UH, THEY'VE DONE A NUMBER, UH, OF, OF 40 OR 50 TIPS THAT THEY'VE DONE.

UH, THEY'VE BEEN ON THE GROUND FLOOR, THIS OF THE TIF THING EVER SINCE THE LEGISLATURE CREATED IT.

UH, TO SAY THAT THEY'RE COMPETENT, UH, WOULD BE, UH, AN UNDERSTATEMENT.

I DARE SAY THEY'RE PROBABLY MORE COMPETENT IN, THEY, THEY HAVE MORE EXPERTISE IN DEVELOPING T IN ANY OTHER ORGANIZATIONS IN THE STATE.

UM, IT'S SORT OF A SENSITIVE SUBJECT, BUT I, I GUESS IT'S, IT IS SORT OF LIKE THE ELEPHANT IN THE ROOM.

I THINK WE PROBABLY SHOULD BRING IT UP.

UM, THE CITY'S BEEN WORKING ON THIS FOR A REALLY LONG TIME, AND WE HAVE DEVELOPED A TIF IN WHICH WE'RE GONNA CONTRIBUTE 50% MORE THAN WHAT WE'RE ASKING THE COUNTY TO CONTRIBUTE.

UH, EVERYTHING IN THIS TIF IS, UH, WELL THOUGHT OUT.

UH, THE FORMULAS HAVE ALL BEEN WORKED THROUGH, AND WHEN AND WHEN THIS IS ALL SAID AND DONE, THE COUNTY IS GOING TO RECEIVE INTO THE GENERAL FUND $42 MILLION MORE THAN YOU WOULD'VE OVER THE LIFE OF THIS TIF.

AND THAT'S MONEY THAT HOMEOWNERS ARE NOT GONNA HAVE TO PAY IN THEIR PROPERTY TAXES.

IT'S GONNA BE PAID BY BUSINESSES, UH, THAT ARE ESTABLISHED AS A RESULT OF CREATING THIS.

TI THINK WHAT'S BEEN GOING ON HERE FOR A LONG TIME IS THAT NOT EVERY, NOT EVERY CITY HAS BEEN, UM, AS, UH, AGGRESSIVE AND AS ASSERTIVE AS, AS WE HAVE IN TERMS OF GETTING STARTED ON THIS, WE RECOGNIZED WHAT THIS TIP WAS AND WHAT THE OPPORTUNITIES WERE WHEN THE LEGISLATURE PASSED IT, AND WE GOT STARTED.

AND, UH, I THINK THAT THAT PUTS US IN A REALLY GOOD POSITION TO BE ON THE GROUND WITH A TIFF A LONG TIME BEFORE ANYBODY ELSE.

AND I BELIEVE THAT WHAT WE'VE BEEN SEEING IN THE LAST FEW WEEKS IS RESISTANCE FROM RESISTANCE FROM, UH, OTHERS WHO ARE NOT AS READY AS WE ARE.

AND I UNDERSTAND THAT, BUT THE, BUT THE PROBLEM FROM THE COUNTY STANDPOINT IS, I THINK THE ONLY THING BEFORE YOU GUYS IS NOT WHAT'S BEST FOR ONE CITY AS OPPOSED TO ANOTHER, BUT WHAT'S BEST FOR THE, WHAT'S BEST FOR THE TAXPAYER, UM, IN COLMAN COUNTY.

AND WE'VE ANSWERED ALL THE QUESTIONS.

WE'VE BEEN GOING THROUGH THIS FOR A COUPLE OF WEEKS NOW.

I KNOW THAT, UH, MR. ROGERS AND MR. KLEIN AND MR. SCHROER HAS SPENT A LOT OF TIME ANSWERING ALL THE QUESTIONS WHEN IT GETS RIGHT DOWN TO IT, AND, UH, YOUR ATTORNEY SAID THIS THE OTHER DAY, AND I'LL WRAP UP WITH THIS, WHEN IT GETS RIGHT DOWN TO IT, UH, IF YOU'RE LOOKING FOR US TO COME TO YOU WITH A PROPOSAL THAT THAT IN WHICH YOU DON'T HAVE ANYTHING TO WORRY ABOUT, WE'RE IT IS A HUNDRED PERCENT GUARANTEED, THERE'S NEVER GONNA BE ANY CHANCE THAT IT'S NOT GONNA WORK, UH, THAT'S JUST NOT GONNA HAPPEN.

AND, AND, UH, WE'RE GOING TO OPERATE IN GOOD FAITH WITH YOU GUYS JUST AS WE HAVE ALWAYS DONE.

WE NEED A LITTLE WIGGLE ROOM WHERE THE NEGOTIATIONS WON'T WORK.

UH, I, AS I SAID, OF COURSE, MY HANGUP IN THE WORKSHOP WAS THE 30 YEAR 50%.

AND, AND A RECOMMENDATION WOULD BE, UH, TO CHANGE THIS, UH, RESOLUTION.

JUST THE WORDING TO SAY UP TO, BECAUSE YOURS SAYS A MINIMUM, I SAY UP TO 50%.

IF YOU SAY 50% IS WHAT IT TAKES TO MAKE THIS WORK.

THERE MAY, DURING THE INTERLOCAL AGREEMENTS, WE MAY THIS DISAGREE ON HOW MUCH IT TAKES TO DO THIS PROJECT.

SO WE NEED A LITTLE BIT OF, OF NEGOTIATING ROOM, UH, TO MAKE THIS WORK.

AND, AND IF IT'S UP TO 50%, IF THIS PROJECT TAKES 50, MAYBE THIS ONLY TAKES 40.

WE NEED, WE NEED TO BE COMFORTABLE BECAUSE WE'RE GONNA HAVE TWO, TWO PEOPLE ON THIS BOARD THAT'S, THAT'S LOOKING OUT FOR THE COUNTY'S INTEREST.

RIGHT.

AND OF COURSE, I HAVE DUE DILIGENCE FOR, FOR THE COUNTY ALSO.

THAT'S, THAT'S MY JOB.

UH, AND I, I STILL HAVE A PROBLEM, BUT I'M GONNA GO WITH A LITTLE BIT OF IT IN THAT I WAS ONLY GIVEN TWO DAYS TO READ THIS WHOLE PATH, UH, AFTER YOU WORKED ON IT FOR TWO YEARS.

I, I SAID THAT THE OTHER DAY AND I STILL FEEL THAT WAY 'CAUSE I'M REALLY NOT COMFORTABLE.

THE TIFF ON THE SURFACE SOUNDS GREAT.

WE CAN PROBABLY RESOLVE IT DURING THIS DISCUSSION.

WE, I THINK WE CAN RESOLVE UP TO 50, THE UP TO 50% THING.

I THINK WE CAN, EVERYTHING THAT THIS TIP IS BASED ON IS BASED ON PROJECTIONS.

NOW, AS WE GO ALONG IN THIS PROCESS, THERE ARE ANY NUMBER OF WAYS IN THE INTERAL AGREEMENT FOR YOU GUYS TO, TO MINIMIZE OR TO, TO LIMIT OR REDUCE YOUR PARTICIPATION WITHOUT TINKERING EFFECTIVELY PERCENT MONEY.

THERE'S GONNA BE, I MEAN, THERE'S ANY NUMBER OF WAYS YOU CAN DO THAT BY TAKING THINGS OUT OF THE PROJECT LIST.

UH, THERE'S ALL KINDS OF WAYS THAT YOU COULD DO THAT.

UH, YOU COULD, YOU KNOW, WE COULD SHORTEN IT.

YOU GUYS COULD SAY, YOU KNOW, THIS ISN'T WORKING OUT.

WE'RE PUTTING IN 50%.

IT'S NOT WORKING OUT LIKE WE WANT TO, UH, WE WANT TO RESERVE THE RIGHT TO, UH, TO NEGOTIATE, COLLAPSING THE TIP EARLY.
