ONE OF THE HATS THAT THE DISTRICT JUDGE IS WEAR IS THE, UH, AUTHORITY TO SUPERVISE, HIRE, AND FIRE THE ADULT PROBATION OFFICERS.
AND, UH, THE CHIEF ADULT PROBATION OFFICER HERE IN COL COUNTY IS DAVID DANIEL.

AND ONE OF OUR RESPONSIBILITIES AS DISTRICT JUDGES IS TO OVERSEE THE, SUPERVISE THIS DEPARTMENT.AND, UH, DAVID AND I VISIT PERIODICALLY.
I THOUGHT IT WOULD BE INTERESTING TO THE COURT TO HEAR SOMETHING ABOUT THE WORK OF THAT DEPARTMENT.
UH, I'M SURE MOST OF YOU KNOW, UH, THAT, UH, ONE OF THE CRIMINAL JUSTICE, UH, PROVISIONS AND THE CODE OF CRIMINAL PROCEDURE IS PLACEMENT OF INDIVIDUALS WHO ARE APPROPRIATE FOR COMMUNITY SUPERVISION OR PROBATION, BE PLACED ON COMMUNITY SUPERVISION AS PART OF THEIR PUNISHMENT.
AND, UH, TECHNICALLY A FELON WHO HAS A TENURE OR LESS SENTENCE WOULD BE ELIGIBLE FOR PRO PROBATION IF THERE'RE FIRST OFFENDER.
SO WE HAVE QUITE A FEW OFFENDERS PLACED ON PROBATION AND SUPERVISED BY THE PROBATION DEPARTMENT.
AND, UH, THERE IS SOME NEED FOR GROWTH IN THE DEPARTMENT.
UH, OUR LEGISLATURE AND ITS WISDOM HAS STOPPED BUILDING PRISONS.
AND SO, UH, WE'VE ACTUALLY HAD A DECREASE IN THE NUMBER OF PRISONERS HOUSED BY THE STATE.
THAT PUTS MORE RESPONSIBILITY ON LOCAL JURISDICTIONS TO DEAL WITH THOSE THAT MAYBE IN THE PAST WOULD'VE BEEN HOUSED BY THE STATE.
SO ONE OF THE WAYS WE DEAL WITH THAT PROBLEM IS TO USE THE COMMUNITY SUPERVISION DEPARTMENT TO PLACE, UH, LOW LEVEL OFFENDERS, NONVIOLENT OFFENDERS, THOSE WHO ARE APPROPRIATE FOR COMMUNITY SUPERVISION, UH, BACK TO THE COMMUNITY, SUPERVISED ON, UH, SOMETIMES WEEKLY BASIS, SOMETIMES A MONTHLY BASIS DEPENDING ON THE LEVEL OF SUPERVISION NEEDED.
LONG STORY SHORT, UH, DAVID'S DEPARTMENT DOES A GREAT JOB, SAVES THE TAXPAYERS A LOT OF MONEY IN KEEPING PEOPLE WHO DON'T NEED TO BE INCARCERATED OUT OF JAIL IN THE PENITENTIARY AND YET SUPERVISES THEM TO BE SURE THAT THE COMMUNITY IS SAFE.
UH, DAVID NEEDS TO ADD SOME PERSONNEL TO HIS DEPARTMENT.
AND SO SINCE THIS IS BUDGET TIME, I THOUGHT THIS WOULD BE APPROPRIATE FOR COMMISSIONERS TO HEAR ABOUT SOME PLANS THAT DAVID HAS FOR THE DEPARTMENT AND SOME OF THE NEED.
I'M GONNA PASS OUT REAL QUICK.
THESE ARE JUST SOME NUMBERS FOR THE PROBATION DEPARTMENT.
JUST SO Y'ALL HAVE AN IDEA OF WHAT WE'RE WORKING WITH.
CURRENTLY, WE SUPERVISE JUST OVER 1200 OFFENDERS HERE IN KAUFMAN COUNTY.
THESE ARE OFFENDERS WHO ARE DIRECTLY REPORTING TO OUR DEPARTMENT, WHETHER IT BE WEEKLY, MONTHLY, BIMONTHLY, WHATEVER THE CASE MAY BE.
AND WE HAVE JUST OVER A THOUSAND OFFENDERS THAT WE SUPERVISE INDIRECTLY.
THOSE ARE OFFENDERS THAT ARE EITHER TRANSFERRED TO OTHER COUNTIES OR THEY ABSCOND.
UM, UP AT THE TOP OF THIS LITTLE PAGE I GAVE YOU, I JUST DID A BREAKDOWN OF HOW MANY OFFENDERS WE HAVE BY ZIP CODE HERE IN COFFIN COUNTY AND ALSO IN OUR NEIGHBORING COUNTIES.
'CAUSE WE SUPERVISE ALL THE WAY OUT INTO DALLAS AS WELL.
UM, AND AT THE BOTTOM I DID A LITTLE BREAKDOWN ON THAT CHART, JUST HOW MANY WE HAVE BY AREA WITH NORTH BEAM, THE TAR, THE TAR AREA, THE NEY AREA, THINGS UP ALONG THAT LINE, CENTRAL BEING KAUFMAN AND CRANDALL.
AND THEN SOUTHERN BEING EVERYTHING SOUTH OF KAUFMAN.
SO YOU CAN KIND OF GOT THE COUNTY BROKEN UP INTO THREE PARTS.
AND YOU CAN SEE WHO WE HAVE WHERE.
UM, AS I SAID, WE HAVE AN INDIRECT POPULATION OF 1086 OFFENDERS.
THOSE ARE PEOPLE THAT WE MAINTAIN FILES ON OR WE ARE ACTIVELY SEARCHING FOR 'CAUSE THEY'VE DISAPPEARED.
AND THEN WE HAVE A TOTAL OFFENDER POPULATION OF 2,312.
UM, THE PERCENT OF THE CO POPULATION IN KAUFMAN COUNTY THAT'S ON PROBATION, IT'S AT ONE OF THE LOWER POINTS WE'VE BEEN AT IN THE PAST FIVE YEARS.
GOING BACK AND LOOKING AT NUMBERS, OUR HIGH POINT OF THE PAST FIVE YEARS WAS 3.9% OF THE COUNTY WAS ON WAS ON PROBATION.
CURRENTLY WE'RE AT 1.05% ON DIRECT POPULATION, ON DIRECT SUPERVISION, AND 0.9% ON INDIRECT FOR A TOTAL OF 2% OF THE POPULATION IS ON PROBATION.
THE REASON THAT'S IMPORTANT IS DOWN AT THE BOTTOM.
IF YOU LOOK AT THE POPULATION PROJECTIONS FOR KAUFMAN COUNTY ITSELF, ACCORDING TO THE TEXAS ASSOCIATION ASSOCIATION OF COUNTIES, KAUFMAN COUNTY'S POPULATION IN 2016 WAS 118,000.
AND SOME CHANGE ACCORDING TO THE OFFICE OF THE STATE DEMOGRAPHER KAUFFMAN COUNTY POPULATION IS ABOUT TO GO THROUGH SOME LARGE RURAL SPURTS.
IF WE'RE AVERAGING 2% OF THE POPULATION ON PROBATION, YOU CAN EXPECT FOR EVERY 10,000 PEOPLE THAT THE POPULATION OF KAUFMAN COUNTY GROWS, THAT'S GONNA BE 200 MORE PEOPLE ON PROBATION.
THAT'S AN OFFICER AND A HALF PER MY DEPARTMENT.
I'M ALREADY AT A POINT RIGHT NOW WHERE I HAVE 13 OFFICERS.
I'VE ADDED ONE OFFICER TO THE DEPARTMENT SINCE I'VE BEEN HERE IN JULY OF 2014 THROUGH NOW.
UM, SO I'VE ALREADY ADDED ONE POSITION.
I HAVE ZERO OFFICE BASE AVAILABLE IN MY BUILDING.
UM, I WAS TALKING TO JUDGE CHINEY.

OPERATE A MENTAL HEALTH DIVERSION COURT, A DRUG COURT, A SAFETY COURT, A UM, SWIFT SANCTIONS COURT.UM, AND ALL OF THESE COURTS, THEY HAVE OFFENDERS THAT NEED SUBSTANCE ABUSE TREATMENT.
CURRENTLY, THE DEPARTMENT IS PAYING A CONTRACT WITH SUBSTANCE ABUSE PROVIDERS TO PAY FOR TREATMENT FOR INDIGENT OFFENDERS.
THE COST OF THAT CONTRACT IS GET TO A POINT WHERE IT EXCEEDS THE COST OF ME ACTUALLY HIRING COUNSELORS MYSELF.
I AM READY TO HIRE COUNSELORS AS EMPLOYEES OF THE DEPARTMENT TO PROVIDE SUBSTANCE ABUSE TREATMENT FOR OUR INDIGENT OFFENDERS AND COMMUNITY.
I HAVE NO OFFICE EQUIPMENT AND I REALLY NEED SOME OFFICE SPACE.
SO THAT'S KIND OF ONE OF THE THINGS I'M BRINGING TO Y'ALL IS AS WHEN I'VE TALKED WITH, UM, SEVERAL PEOPLE IN THE COUNTY GOVERNMENT, ACCORDING TO GOVERNMENT CODE, THAT'S THE ONE THING THAT THE COUNTY HAS TO PROVIDE FOR PROBATION DEPARTMENTS IS, UM, OFFICE SPACE AND OFFICE FURNITURE.
I'M AT A POINT WHERE I HAVE TO REQUEST SOME ADDITIONAL OFFICE SPACE I PUT DOWN AT THE BOTTOM.
IDEALLY I'D LIKE ABOUT FOUR OFFICES IN KAUFMAN AND ABOUT THREE OR FOUR IN MORNING WITH THE ABILITY TO EXPAND IN THE FUTURE.
NOW SITTING THERE ADDING UP TO EIGHT OFFICES, PEOPLE MIGHT THINK, WELL, THAT'S A HUGE EXPANSION IN A REALLY SHORT PERIOD.
AS I SAID, I WANT TO ADD THE COUNSELOR POSITION.
ULTIMATELY, I'M READY TO HIRE A COUNSELOR RIGHT NOW IF I HAD THE OFFICE SPACE AND I'M LOOKING AT ADDING TWO ADDITIONAL COUNSELORS NEXT YEAR, THERE'S THREE POSSIBLE POSITIONS RIGHT THERE THAT ARE FULL.
IT IS, THERE'S JUDGE CHINEY HAS PUT TOGETHER A COMMITTEE TO LOOK AT PRETRIAL BOND SUPERVISION, UM, PERSONAL RECOGNIZANCE BONDS IS, AND TO LOOK AT SUPERVISION OF THAT, THE PROBATION DEPARTMENT MEETING.
SUPERVISION, THAT WOULD BE ADDITIONAL STAFF.
I DON'T HAVE THE OFFICE FIX FORMAL, SO I COULD TAKE ON SOME OF THAT PRETRIAL SUPERVISION ASPECTS.
IF WE GET EVERYTHING LINED OUT THAT'S ON THE OFFICE SPACE.
SO EVEN ADDING FOUR DAY FOUR TO ABOUT FOUR TO EIGHT OFFICES, WE HAD THOSE.
RIGHT NOW YOU'RE LOOKING AT, AT ABOUT A YEAR, MAYBE THREE YEARS, I'D HAVE THE VAST MAJORITY OF THOSE OFFICES THAT WE VACATED IN THE TERRA OFFICE BUILT BACK UP.
SO WE ARE GOING THROUGH A LOT OF GROWTH, A LOT OF EXPANSION, AND LOOKING AT POPULATION PROJECTIONS.
THERE'S A LOT MORE COMING DOWN BEHIND.
I KNOW COMMISSIONER, I THINK WITH PHILLIPS HAS ALREADY TALKED TONEY AND THERE'S SOME COMMUNICATION GOING ON THERE, THERE, UM, LIKE THAT'S SOME POSSIBILITIES.
WELL, WE CAN, AND I KNOW TALKING TO THE TREASURER'S OFFICE, I'VE GOT A LOT OF MY OFFENDERS RIGHT NOW THAT ARE DOING COMMUNITY SERVICE OVER AT THE POOR FARM AND THEY'VE KNOCKED OUT A TON OF STUFF OVER THERE.
AND THAT'S ONE OF THE THINGS I'M LOOKING AT IS IF I CAN GET OFFENDERS TO REPORT IN THE COMMUNITIES WHERE THEY LIVE, IT'S A LOT EASIER TO DO THOSE CSR PURPOSE.
I KNOW COMMISSIONER BARBER'S OFFICE HAS REACHED OUT TO ME A COUPLE TIMES FOR OFFENDERS AND RIGHT NOW I'M HAVING THIS IN THE BLAST EMAIL TO ALL 13 OF MY OFFICERS SAYING, HEY, I NEED OFFENDERS FROM LL TO GO OUT WORK AT THE COUNTY COMMISSIONER'S OFFICE, UM, TO DO SOME WORK THERE.
AND SO I'M HAVING TO GO THROUGH ALL 1200 OFFENDERS INSTEAD OF DIVIDING IT DOWN TO FOUR OR 500 OFFENDERS AND SAY, HEY, LET'S PICK OUT THESE SPECIFIC PEOPLE.
I THINK THAT'D BE A HUGE BENEFIT TO, UM, GETTING THESE LOCALIZED OFFICES.
AND THEN I KNOW Y'ALL ARE GONNA BE LOOKING AT STAR TRANSIT RIGHT NOW IN MY BUDGET, I'M SPENDING ABOUT $1,500 A YEAR JUST FROM STAR TRANSIT TICKETS TO PROVIDE TRANSPORTATION FOR VENDOR ORGEN.
AND THEY DON'T HAVE THE MONEY TO BUY THE TICKETS THEMSELVES AND THEY DON'T HAVE TRANSPORTATION.
IF WE'RE ABLE TO GET THESE LOCALIZED OFFICES, THAT'S ADDITIONAL FUNDS TO WHERE INSTEAD OF PAYING FOR SOMEONE TO GO FROM MAYBANK OR KEMP UP TO TERRELL, WELL THEN THEY'RE JUST GOING RIGHT THERE TO KAUFMAN.
OR IF THEY LIVE OVER IN FORNEY, THEY'RE JUST GOING RIGHT TO FORNEY OR WHATEVER THE CASE MAY BE.
AND THAT WOULD REALLY HELP US OUT ABOUT AS WELL 'CAUSE THE TRANSPORTATION ASPECT.
SO RIGHT NOW, THAT'S KIND OF JUST A REAL QUICK SNAPSHOT.

OUR FELONY OFFENDERS HAVE INCREASED, UM, BY, BY NUMBER.
AND THOSE FELONY OFFENDERS, THOSE ARE OFFENDERS WHO ARE TYPICALLY ON PROBATION ANYWHERE FROM THREE UP TO 10 YEARS.
SO THOSE ARE LONG TERM PLACEMENTS.
THE MISDEMEANOR, UM, DIRECT PLACEMENTS ARE DOWN.
HOWEVER, IF YOU LOOK AT THE PRETRIAL DIVERSION, THE PRETRIAL TRIAL DIVERSION FOR MISDEMEANORS HAS GONE WAY UP.
PRETRIAL DIVERSION IS A, A SYSTEM THAT COUNTY COMMISSIONERS AND THE DA'S OFFICE CAN APPROVE AND PUT INTO PLACE TO ALLOW OFFENDERS TO GO THROUGH AND MEET CERTAIN CIRCUMSTANCES AND NOT HAVE THEIR CASES PROSECUTED.
JUST HAVE 'EM BE DISMISSED, KIND OF GO OFF TO THE SIDES WHERE THEY DON'T HAVE THAT CONVICTION.
THE PROBATION DEPARTMENT, WE SUPERVISE THOSE CASES FOR THE COUNTIES.
WE RECEIVED ZERO FUNDING FROM THE STATE TO SUPERVISE THOSE CASES.
THAT IS SOMETHING THAT WE'RE DOING JUST TO KIND OF HELP THE ENTIRE SYSTEM ALONG.
RIGHT NOW I HAVE TO LOOK AT THE TOTAL NUMBER OF MISDEMEANOR

OFFENDERS I HAVE ON PRETRIAL DIVERSION.THAT'S A FULL STAFF POSITION THAT I RECEIVED NO FUNDING FROM THE STATE FOR.
ALL WE GET IS THE $60 PER MONTH SUPERVISION FEE IF THE OFFENDER'S PAYING IT.
SO I'VE GOT A LOT OF PIECES OUT THERE WHERE I'M TRYING TO BALANCE.
UM, BUT I'M AT A POINT WHERE I REALLY NEED TO DO SOME GROWTH IN ORDER TO MAINTAIN AND IMPROVE SUPERVISION.
LET'S JUST HAVE A REAL QUICK SNAPSHOT,
JUST SO, UH, WE'VE LOOKED AT THE, UH, FACILITIES DEPARTMENT HAS LOOKED AT THE BUILDING ACROSS THE STREET FROM MY OFFICE, THE OLD LIBRARY.
AND WE ARE IN PROCESS OF TRYING TO DO SOME THINGS TO, UH, UH, REMODEL AND IT TO MAKE IT ACCEPTABLE FOR THAT.
UH, AND OUR FACILITIES DEPARTMENT IS WORKING ON THAT NOW.
AND, UH, WE'VE GOTTA, UH, PUT IN A A PUBLIC RESTROOM OR PUT IN A RESTROOM AND, UH, BUT WE'VE MOVED ALL MATERIALS.
I BELIEVE THAT THERE WERE SEVERAL, UH, WELL I HOW MANY DOZENS AND DOZENS OF, UH, DISTRICT ATTORNEY RECORDS THAT WERE UPSTAIRS.
THOSE HAVE NOW BEEN MOVED OUT TO THE, UH, FACILITY WHERE WE HAVE THE THREE PORTABLE BUILDINGS THERE.
SO WE'RE TRYING TO WORK IN THAT DIRECTION SO THAT IT WOULD BE A TEMPORARY LOCATION UNTIL WE FIGURE OUT SOMETHING BETTER.
I DUNNO WHERE IF YOU HEARD ANYTHING DEFINITIVE FROM THE CITY OF NO, THEY DID.
THEY DID TELL ME THEY HAD THREE OR FOUR OFFICES AND THEY WERE GONNA CHECK CHIEF WHERE THEY STOOD ON THAT.
I TOLD THE CITY MANAGER HIS INFORMATION, VICE VERSA.

UM, WITH THE HIGHER ONE BEING 149,000 PEOPLE BY 2020, THAT'S, IF MIGRATION RATES CONTINUE THE SAME AS IT WAS FROM 2000 TO 2010, JUDGE CHITTY COULD PROBABLY SPEAK BETTER TO THIS THAN I COULD, BUT I KNOW IN TALKING TO SOME OTHER COUNTIES, ONCE THE COUNTY'S HIT ABOUT THAT 150,000 MARK, THAT'S NORMALLY WHEN A THIRD DISTRICT COURT IT'S ADDED.
UM, AND THAT'S ANOTHER THING THAT KIND OF IN THE KEEP THE BACK OF YOUR HEADS LANDING ON FOR ONCE WE HIT AROUND THAT 150,000 MARK, IF THERE'S AN ADDITIONAL DISTRICT COURT THAT'S ADDED BASED ON POPULATION AND NEED, THAT'S GONNA INCREASE THE FLOW OF PROBATION AS WELL.
SO THAT, I MEAN, JUDGE CHASE COULD PROBABLY SPEAK BETTER TO THAT ASPECT.
AND I COULD, LEMME JUST VERY BRIEFLY SAY A COUPLE THINGS.
KIND OF THE RULE OF THUMB ON DISTRICT COURTS IS ONE COURT FOR EVERY 50,000 POPULATIONS.
SO WHEN WE GET TO THAT ONE 50 MEMBER, WE'RE GOING TO PROBABLY HAVE TO ASK THE LEGISLATURE TO CREATE A NEW COURT.
AS ALL OF YOU ARE WELL AWARE, WE HAVE NO PLACE TO PUT A NEW COURT.
AND, UH, SO IT'S THE OLD, UH, STORY ABOUT NEEDING A NEW COURT'S BUILDING THAT WE'D LIKE FOR THE COMMISSIONERS TO KEEP AT THE FOREFRONT OF YOUR THOUGHTS BECAUSE, UH, WE MAY BE LOOKING AT THAT AS SOON AS FOUR YEARS.
AND SO THAT'S GOING TO TAKE SOME PLANNING AND SOME EXECUTION OF PLANS TO GET A, A COURTS BUILDING IN PLACE THAT WILL ACCOMMODATE THE NEEDS OF THE PEOPLE OF CATON COUNTY.
UH, ONE OTHER THING I WANTED TO MENTION, AND THAT IS THE FREETRIAL RELEASE PROGRAM.
UH, THERE HAS BEEN A FEDERAL LAWSUIT FILED IN HARRIS COUNTY ATTACKING, UH, THE CONSTITUTIONALITY OF THE WAY THEY DEAL WITH INDIGENT LOW LEVEL OFFENDERS.
UH, THE BOND SYSTEM HAS BEEN STRUCK.
THEIR BOND SYSTEM HAS BEEN STRUCK DOWN AS BEING UNCONSTITUTIONAL IN VIOLATION OF CIVIL RIGHTS OF INDIGENT, LOW LEVEL NONVIOLENT OFFENDERS.
UH, WE'RE TRYING TO GET AHEAD OF THAT CURVE HERE IN TON COUNTY BY CREATING A PROTOCOL OR A PRETRIAL RELEASE OF THOSE LOW LEVEL OFFENDERS.
UH, AND THAT WOULD REQUIRE SOME SUPERVISION.
DAVID ALLUDED TO THAT IN HIS S ABOUT THREE TRIAL RELEASE PROGRAM AND UH, I'VE ASKED ANDREW JORDAN TO CHAIR THAT COMMITTEE.

JUDGE, I KNOW YOU'RE AWARE OF THE BELL COUNTY SYSTEM.
UM, IT'S SOMETHING THAT I THINK WE'RE GOING TO SEE NECESSARY IN ALL COUNTIES IN THE NEAR FUTURE, AND WE'RE TRYING TO GET AHEAD OF THAT.
THAT WOULD REQUIRE S OFFICE, HOUSE, THAT PRETRIAL POLICE OFFICER, ANOTHER OFFICE SPACE.
SO JUST, UH, ONE OF THE COMMISSIONERS BE AWARE OF KIND OF THE DIRECTION THAT THAT OFFICE IS, IS GOING AND THE GROWTH THAT WE ANTICIPATE SO THAT THERE WILL BE NO SURPRISES IN THE NEXT COUPLE OF YEARS.
JUDGE WAS IS THERE LEGISLATION, WHEN THERE'S SOME LEGISLATION THAT WAS PASSED THIS SESSION, ARE YOU AWARE OF ANY THAT WOULD SPEED THIS UP EVEN MORE SO THERE, I FRANKLY HAVE NOT CAUGHT UP WITH THE LEGISLATURE YET OF WHAT EXACTLY HAS PASSED IN WHAT FORM? UH, I WILL SAY THAT THERE HAS BEEN A TREND OVER THE LAST TWO SESSIONS OF, UH, DEALING WITH INDIGENT OFFENDERS IN SUCH A WAY THAT, UH, THERE IS MORE INCLINATION TO FAVOR THE OFFENDER AND LESS INCLINATION TO FAVOR THE PROSECUTION.
AND, UH, I THINK YOU'RE GOING TO SEE MORE UTILIZATION OF PROBATION AND PRETRIAL RELEASE KIND OF, UH, PROGRAMS. I THINK YOU'RE GOING TO SEE NO LONGER ANY ABILITY CONSTITUTIONALLY TO HOUSE AN INDIGENT OFFENDER WITHOUT A, UH, PR BOND UNLESS THEY ARE A DANGER OF TYING OR A DANGER OF BEING A THREAT TO THE SECURITY OF THE COMMUNITY.
UH, SO, UH, SENATOR WHITMEYER IS AT THE FOREFRONT OF THESE PROGRAMS. I KNOW HE HAD A BILL ON PRETRIAL RELEASE.
ANDREW, DO YOU KNOW WHAT THE STATUS OF THAT WAS? I DO.
IT, UH, THERE WAS CONCURRENT LEGISLATION.
IT ACTUALLY PASSED PRETTY OVERWHELMINGLY THE RELEVANT COMMITTEES FROM THE HOUSE AND THE SENATE.
AND THEN AS PART OF LEGISLATION IT GOT JAMMED UP ON THE CALENDAR COMMITTEE ONE, TWO.
SO IT DIDN'T GO THROUGH IT, IT DID NOT PASS WITH THE GOVERNOR.
BUT GIVEN THE WAY THE COMMITTEES VOTED, IT'S A FAIR ASSUMPTION IF IT COMES BACK UP THE NEXT LEGISLATURE THAT THEY GOT THE VOTES PASSES.
I THINK IT'S COMING AND, UH, PROBABLY SHOULD, MAYBE IT'S SOMETHING ELSE I READ, BUT I, THERE'S SOME BILL I THOUGHT THAT DEALT THIS THAT WAS ON THE GOVERNOR DESK AND DID NOT SIGN IT.
BUT I'LL, I'LL GO BACK AND REVIEW.
THERE, THERE WAS SOME LEGISLATION REGARDING, UH, PAYMENT OF FEES THAT DID PASS, DID PASS AND I BELIEVE HAS ALREADY BEEN SIGNED.
AND THOSE BILLS JUST FOR THE COMMISSIONER'S INFORMATION, UH, UH, OUR COLLECTIONS DEPARTMENT HAS KIND OF BEEN TURNED ON ITS HEAD.
UH, THE, UH, OFFICE SUPPORT ADMINISTRATION, THE, UH, CHIEF JUSTICE OF THE TEXAS SUPREME COURT AND OTHERS HAVE PRETTY WELL DECREED THAT YOU CANNOT IMPOSE FINES ON INDIGENT OFFENDERS AND THEN JAIL THEM IF YOU DO IMPOSE A FINE JAIL THEM FOR THE INABILITY TO PAY FINE.
SO, UH, THAT IS GOING TO CUT INTO, UH, SOME REVENUE FOR THE COUNTIES, OBVIOUSLY.
AND WE'RE GOING TO HAVE A SITUATION WHERE, UH, IF THE INDIGENT OFFENDER HAS COURT APPOINTED COUNSEL, THEN IT'S GOING TO LIMIT THE ABILITY OF THE DA TO NEGOTIATE A FINE AS PART OF THE PLEA BARGAIN IF THERE'S NO ABILITY TO PAY FINE.
SO IT'S JUST ANOTHER ONE OF THOSE SQUEEZES AT, UH, THE LOCAL LEVEL WHERE ANOTHER SOURCE OF REVENUE MAY BE SHRINKING.
AND, UH, AGAIN, IT'S, IT'S PROBABLY NOT A BAD RULE OF THUMB IF THE PERSON'S INDIGENT AND CANNOT AFFORD TO PAY, YOU SHOULD NOT JAIL THEM FOR THE INABILITY TO PAY.
BUT I THINK THAT'S THE LEGISLATION ANDREW IS TALKING ABOUT ON FINES AND FEES.

THEY'RE FOR FEDERAL HIGHWAYS, THEY'RE ON STATE HIGHWAYS.
SO IT'S ESSENTIALLY DEBT WITH NOT AN ASSET TO OFFSET IT.
SO THAT'S ONE OF THE REASONS WHY, SAY IF YOU, THEY WERE TALKING ABOUT A JUSTICE BUILDING EARLIER, IF YOU ISSUE BONDS FOR THAT, YOU'D HAVE THE DEBT, THEN YOU TAKE THAT CASH AND TURN IT INTO A BUILDING.
SO YOU'D HAVE A ASSET SO THAT THE NET EFFECT ON EQUITY WOULD BE ZERO, PAY THE DEBT OFF, DEPRECIATE THE BUILDING AND THOSE WOULD KIND OF GO TO ZERO TOGETHER.
SO THESE ARE DIFFERENT IN A LOT OF COUNTIES IN THIS AREA THAT ARE DOING THESE PROJECTS.
THIS ISN'T ANYTHING THAT, THAT I THINK WE NEED TO REALLY FOCUS ON, BUT IT IS SOMETHING THAT IS USERS OF THE FINANCIALS.
LOOK, IF PEOPLE DON'T UNDERSTAND THESE, THEY'RE GONNA LOOK AND SAY WE DON'T HAVE ANY MONEY.
AND THAT'S NOT NECESSARILY WHAT THIS IS SAYING.

SO WE'RE ALMOST A YEAR AND A HALF BEHIND BECAUSE BY THE TIME THEY GET THOSE FINANCIALS DONE, WE CAN'T GET THEM INCLUDED.
THEY CAN'T GET THEIR REPORTS DONE AND ALL THE STUDIES DONE IN TIME.
SO WE'RE ALWAYS A YEAR AND A HALF BEHIND.

SO, UM, AGAIN, THAT, THAT FUND BALANCE IS AT 31.7 THAT'S GOING TO CONTINUE TO GO DOWN WITH THE ISSUANCE OF CASH.
