A REGULAR MEETING

OF THE KAUFFMAN COUNTY COMMISSIONER'S COURT.

UH, THIS IS OUR FIRST REGULAR MEETING FOR THIS YEAR.

THERE WILL BE, OUR MEETING WILL ALL BE ON WEDNESDAY, UH, NOW THE REST OF THIS YEAR.

AND, UH, MAYBE THE LEGISLATURE WILL COME BACK AND CHANGE, UH, THAT UP AND NEXT SESSION WE'LL HAVE TO WAIT AND SEE.

BUT, UH, WE DO WELCOME YOU THIS MORNING.

IF THERE'S ANYONE HERE THAT WOULD, UH, LIKE TO ADDRESS THE COURT ON ANY OF THE ITEMS THAT ARE LISTED HERE ON THE AGENDA, PLEASE, UH, FEEL FREE TO DO SO.

THERE IS A SIGN IN SHEET, UH, OUT ON THE TABLE AND, UH, IF YOU WOULD, UH, AND AGAIN, THE ITEM WILL NEED TO BE ON THE AGENDA AND GIVE IT TO OUR COUNTY CLERK, UH, IN THE, UH, BACK OF THE ROOM.

AND COMMISSIONER, I BELIEVE THIS, UH, WAS, UH, IN YOUR PRECINCT.

UH, SO YOU WANNA TALK TO US A LITTLE BIT ABOUT THAT? YEAH, IT, IT IS, IT IS, UH, MAN, MR. A DID RIGHT THERE AND, UH, ASKED IF I'D PUT THIS ON THE COURT.

BASICALLY WHAT HE DID, UM, I DIDN'T KNOW WHAT I CALLED RANDY ABOUT IT.

WHICH ONE? UM, AND, UH, I CHECKED WITH THE LEGAL DEPARTMENT AND CHECKED WITH THE STATE.

THE HOMEOWNER'S ASSOCIATION GRANTED HIM PERMISSION.

AND AT THE BACK, WHEN YOU GO TO THE OTHER PAGE HERE, YOU CAN SEE THAT THIS IS THE ACTUAL APPLICATION THAT WE HAD TO RECEIVE.

AND, UM, EVERYTHING HAS MET WITH, UH, WITH PUBLIC WORKS EXCEPT FOR THE ACREAGE.

THIS PROPERTY IS 1.3, TOP THREE OR FOUR.

I DON'T, YES SIR.

YOU CAN SEE THE DRAWING HERE OF THE SPRINKLERS AND STUFF.

IT WILL BE ON A TIMER FOR NIGHT, WHICH ALL THAT DOES PASS WITH, WITH US, EXCEPT FOR THE FACT THAT IT IS ONE ACRE AND IT IS TWO RESIDENCE ON THAT ONE ACRE.

SO I DON'T, I DON'T HAVE A, I DON'T HAVE AN ISSUE WITH IT.

AND I THINK UNDER THE, UNDER THE REQUIREMENT, THE SYSTEM IS, YOU KNOW, DESIGNED FOR, YOU KNOW, UH, UH, FOR THE LOT AND CAN MEET AND EXCEED THE MINIMUM PUBLIC HEALTH STANDARDS, IT WILL HAVE NO ADVERSE EFFECTS ON PUBLIC WELFARE.

IT WILL, IT'S DESIGNED TO CARRY THE LOAD OF ALL THIS AND IT WOULD MEET THE STATE REQUIREMENTS AS FAR AS THE BASIC STATE LAW IN TEXAS, ALL COUNTIES.

AND MOST ALL COUNTIES DO ADOPT AT LEAST THE ONE ACRE RULE FOR, UH, FOR OTHER, YOU KNOW, SITUATIONS WE'VE, WE'VE ENCOUNTERED IN THE PAST, THE PRIMARY CONCERN THAT WE HAVE WITH TWO RESIDENCES ON ONE SYSTEM, AND WE ARE RUNNING THIS ISSUE AT LEAST THREE OR FOUR TIMES, IF IT EVER IS SPLIT OR SOLD SEPARATELY OR EVER EVEN SUBDIVIDED AGAIN, WHICHEVER HOUSE CARRIES THE ELECTRICAL LOAD TO RUN THIS PUMPS AND EVERYTHING FOR THE SYSTEM, IF THE ELECTRICITY'S TURNED OFF OF THAT HOUSE, THE SYSTEM FAILS BECAUSE THE OTHER USING IT.

AND THAT'S, THAT'S ONE OF THE BIG ISSUES OF HAVING TWO ON THE ONE ACRE OR TWO, WE ACTUALLY PREFER ONE HOUSE PER SYSTEM, UH, IS OPTIMUM.

THAT WAY IF THEY DO SPLIT UP OR ONE LOSES ELECTRICITY OR CELLS OR WHATEVER, WE DON'T HAVE TO WORRY ABOUT IT.

'CAUSE THERE'S NO ACTIVITY, NO ELECTRICITY, NO WATER, THERE'S NO CONCERN.

AND THEN THE OTHER HOUSE WOULD'VE ITS OWN SYSTEM.

SO THAT'S, THAT'S OUR PRIMARY CONCERN.

IF IT'S A SITUATION WHERE THE COUNTY CAN BE ASSURED THAT, UM, THERE WOULD NEVER BE SEPARATION OF SALE OR OUTSIDE THE FAMILY OR, OR THE ELECTRICAL ISSUES THAT I JUST DISCUSSED, IS OUTSIDE STATE LAW, THE ONLY REASON THAT MR. MCKENZIE HAD TO DENY, AND THE ONLY REASON WOULD TELL THE FACT THAT IT WENT AGAINST WHAT WAS ADOPTED AND APPROVED BY THE COUNTY COURT.

BUT THAT DOES PROVIDE FOR A VARIANCE.

YES SIR.

IT DOES.

AND, UH, YEAH, I DON'T HAVE A PROBLEM.

I I KNOW THE HOMEOWNERS ASSOCIATION, I KNOW THE, THE PEOPLE INVOLVED CAN'T BE SEPARATED AND CAN ONLY HAVE ONE FAMILY.

THEY'RE NOT ALLOWED TO BY RULES IN THEIR OWN ASSOCIATION.

SO THEY CAN BE SOLD, SEPARATED OR ANYTHING.

AND HE'S MAINTAINING ALL THE COSTS AND EXPENSE ANYTHING.

SO THE ONLY OTHER, SORRY SIR.

THAT'S NOT, THE ONLY OTHER CONSIDERATION THAT THE COUNTY COURT MAY NEED TO CONSIDER IS THE FACT THAT BECAUSE OUR MORE RESTRICTIVE, UH, REGULATIONS HAD TO BE APPROVED BY TCEQ, THEN WE'RE NOW BOUND BY THOSE RULES.

NOW I THINK THERE'S A, A VARIANCE IN THERE, BUT THAT DOESN'T NEGATE THE FACT THAT TCEQ COULD SAY, HEY, WE APPROVED FOR YOU TO HAVE THESE RULES AND NOW THAT YOU ARE NOT ABIDING BY THE RULES, WHICH WOULD REALLY BE NO DIFFERENT THAN ABIDING BY THE STATE'S RULES, IN MY OPINION, THAT, UM, THE COUNTY COULD BE SUBJECT TO ADMINISTRATIVE LIABILITY UPON PCQ.

I THINK LEGAL MAY WOULD HAVE A LITTLE BIT MORE INFORMATION ON THAT.

BUT AM I CLOSE? YOU ARE CLOSE.

I THINK THAT THE ONE FACT THAT HELPS YOU IS THAT YOU'RE NOT, EVEN THOUGH YOU HAVE TWO RESIDENCES, IT'S STILL OVER ONE ACRE.

SO YOU ARE AT THAT HALF ACRE PER RESIDENCE, WHICH IS THE STATE LAW.

MINIMAL.

SO ANYTIME YOU'RE GOING BELOW THE HALF ACRE, YOU RUN THAT RISK A LITTLE BIT MORE.

MY MY ONLY CONCERN IS WE HAVE THE, WE HAVE THE RULES IN PLACE FOR A REASON AND, AND, AND, AND I DON'T WANNA GET CAUGHT UP IN THE GOOD OLD BOY SYSTEM.

AND I UNDERSTAND WHAT YOU'RE TALKING ABOUT.

THE HOA AND, AND EVERYBODY, IT'S A GREAT PLACE TO LIVE AND EVERYBODY WATCHES AND MONITORS AND STUFF LIKE THAT.
